Michael Jack freed in relation to brother’s death

Michael Jack has been found not guilty of the murder of his half-brother Tishawn Henley.

A High Court jury handed down the verdict in Tortola this afternoon (July 22), months after the fatal stabbing on November 6, 2012.

Henley was stabbed during a fight that unfolded at a home occupied by both men’s mother in North Side, Tortola.

Prosecutors have tried to convince the nine-member jury that Jack deliberately killed his brother, but Jack’s attorney Stephen Daniels argued that it was done in self-defense.

In presenting its case, the prosecution argued that Henley tried to ascertain the whereabouts of his antenna when an argument developed with Jack.

Jack stabbed Henley during the fight, the prosecution further argued.

The defence however maintained that Jack acted in self defence after being provoked by Henley.

It further stated that Jack tried to walk away to avoid a physical confrontation but was shoved and punched by the brother who is now dead.

The defence further stated that it was Henley who ran into the knife that was being held by Jack.

The prosecution disputed that claim and pointed to the forensic report furnished by pathologist Dr. Bruce Hyma. The report indicated that the stabs were not consistent with someone running into a knife.

Prosecutor Tiffany Scatliffe further noted that Jack not only stabbed his brother, but drove away from the scene leaving him to die.

The nine-member jury today sided with the defence and freed Jack of the murder charge.

Justice Albert Redhead had asked the jurors to find not guilty if they think he acted in self defence.

Jack could have been found guilty of either murder or the lesser charge of manslaughter, but the jury thought there was not enough evidence to support those charges.

    is the prosecution falt, they should have charge him for manslaughter.them just wasting tax payers money.

      why dont you shut your trap. What the hell do you know about him not having a family. do you know the tears that his mother shed as she prayed for him constantly???????????? What the hell are you trying to say… you make children but you cant make their minds only pray for them.

    i think this is just a case where the jury decided they were not going to find this man guilty regardless of the facts. I don’t think he was guilty of murder because they would have had to prove that he intended to kill his brother. But I think he certainly WAS guilty of manslaughter based on the facts of the case. At least it is the same family so either way – joy or sorrow – justice or injustice it is all theirs to deal with.

      And for all the time the Zimmerman jury took they still came back with a asinine decision, so the length of the deliberation does not equal a sensible verdict… :lol: :lol:

    I’m happy for Jack but there is nothing to celebrate. His brother is still dead and he has to live with that for as long as he lives. My prayers go out to him and his family especially his mother as I can’t imagine what she is going through!
