The matter involving Oswin Barker, the chef accused of rape, was today, July 3 traversed to the October criminal assizes.

Following the decision, Justice Albert Redhead extended the defendant’s $75,000 bail that was signed with two sureties along with other requisites.

It is alleged that the 37-year-old committed the act sometime between March 21 and 22, 2012 at the Brandywine Bay beach.

The court heard that the defendant had allegedly taken the VC and her friend to a bar in Long Bush, and sometime after he took the VC’s friend home but drove past the VC’s residence to the Brandywine Bay area, even though the complainant protested.

The complainant allegedly asked the defendant where he was going and he reportedly told her he wanted to speak to her. She allegedly asked the defendant to take her home, stating that she was sleepy and tired.

It was stated that Barker told the VC that he liked her a lot and asked her if she couldn’t see that. He also reportedly told her that he would do anything for her and that’s why he and his girlfriend were not presently on good terms.

During the alleged rape, the VC reportedly punched the defendant in his face and bit him in his chest.

It was announced that when officers informed the defendant of the report that had been made against him he said: “Me not me officer, I never raped that girl.” However, the defendant stated that he did have sexual intercourse with the VC on more than one occasion and announced that the VC was his girlfriend.

MAY 1, 2012 REPORT: Chef in rape case taken to High Court

The matter involving Oswin Barker, the chef accused of rape, was committed to the High Court yesterday, April 30 by Magistrate Tamia Richards.

The case was called in the High Court today, May 1 and it was decided that the defendant would be arraigned on May 21.

Assizes manager Principal Crown Counsel Tiffany Scatliffe told the court that the arraignment date will give the Magistrate’s Court some time to complete the deposition.

Meanwhile Barker’s Attorney Stephen Daniels was successful in his application to have his clients’ bail varied.

Judge Albert Redhead revoked the $15,000 cash component that had been ordered in the Magistrate’s Court and granted bail with all of the other requisites. This means that the defendant is on $75,000 bail signed with two sureties.

Barker, who first appeared in court on March 26, resides at East End and allegedly committed the act sometime between March 21 and 22, 2012 at the Brandywine Bay beach.

    They were both in a relationship for a while, and maybe something went wrong make she calling rape. The truth will reveal in court.

      Not all. Some do it for the thrill. Some will stop at nothing to have sex with the woman they want. I know a lot of rapists with good self esteem.

            @hill side billy, I was using yellow as an example lol. I am confused on what you are trying to say, what does ‘under 4 eye even’ means? In law a woman cannot be charged with rape, they can only be charged with sexual assault.

            No it would not be a charge of indecent assault it would be a charge of sexual assault since technically a woman cannot rape a man.

            I just checked with a friend, he said that it would be indecent assault in the BVI as you stated. I go to school in the UK and it would be sexual assault up here, he said that the UK used to have indecent assault but it was replaced by the Sexual Offences 2003 Act
