It is no April Fool’s Day joke.

BVI News Online has just confirmed that businessman Desmond “DA” Alphonso, who was acquitted on March 4, 2010 of murdering wanted man Christopher Bailey in 2006, has filed an appeal through his lawyer against a deportation order.

Alphonso, who was served his deportation paper last Friday, had his appealed file today by lawyer Stephen Daniels of Vernon E. Malone & Co., sources say.

The Guyanese-born businessman had seven days in which to appeal the deportation.

Discreet information

When BVI News contacted Daniels to find out the grounds of the appeal he could not disclose the information at the time, since he said that would mean revealing certain private things about Alphonso.

Copies of the appeal were sent to the offices of Governor David Pearey and the chief immigration officer at about mid-day, Daniels noted.

When asked how optimistic he was about the appeal matter, Daniels replied, “Well the Governor has to give grounds as to why Alphonso cannot stay.”

He also referred to the Immigration and Passport Ordinance Chapter 130 Section 40 which states that it does not guarantee a person a hearing since the Governor has the discretion whether to hear the appeal.

“All it provides for is an appeal by way of letter and the Governor has the discretion whether to hear the appeal or not, but Section 18 of the Constitution of the VI provides that before anyone is deported out of the Territory, it must be done under prescribed laws, must be given a hearing and entitled to legal representation,” he explained

INTERVIEW EARLIER THIS MONTH

Speaking to ZBVI radio in an interview earlier this year, Governor David Pearey said a letter calling for Alphonso’s deportation is widely circulated, but he cannot comment on individual cases of deportation or on the said letter.

“All such instances, where the powers are available to the Governor, are considered very carefully and without exception and we  use the powers very sensibly to ensure that those who transgressed and who matched the criteria of the Immigration Act are given careful consideration for deportation and many people are so deported,” Governor Pearey said.

Before his acquittal, Alphonso served a four-year term for harboring Bailey, Andrew ‘Ratty’ Milton and Dennis ‘Soupy’ Campbell. The Jamaicans were the main suspects in the death of Jamaican Dorcas Rhule who was thrown from her fourth floor Little Dix apartment on October 3, 2006. Milton and Campbell are currently serving 35 years each for the crime.

“As a BVIslander I thought it important to submit my recommendation for the deportation of Mr. Desmond ‘DA’ Alphonso. Mr. Alphonso was born in Guyana and grew up in the British Virgin Islands (BVI). The BVI has been very kind to Mr. Alphonso who has been able to own several businesses. Unfortunately, Mr. Alphonso was not as kind to the BVI, her citizens, nor her visitors and his crime should not go unnoticed,” a part of the letter, obtained by BVI News, states. Meanwhile, commenting generally on the issue Governor Pearey told ZBVI radio that certain issues are taken into consideration when a person is being deported from the BVI. He noted that it is a power given to the Governor within the Immigration Act – under certain conditions.

‘It (the Act) is used pretty sensibly,” he said. “The way it works at the moment is that the Premier makes a recommendation to the Governor, because he is directly responsible for immigration matters, he looks at these cases and makes recommendation to the Governor, and invariably the Governor certainly since my tenure here, would agree with the proposals from the Premier; where there may be issues that need be considered again, I will discuss these matters with the Premier and we may look for alternative outcomes, but generally speaking, the deportation element in the Immigration Act works very well and we have a pretty tough regime.”

Governor Pearey reportedly said that the Immigration Act has made it very clear that if you breach the immigration laws in some way or the other, or if you have committed a crime and was sentenced to three months or more, or its equivalent,  then such person will be up for consideration for deportation – and many such people are so deported.

However, the Governor told the radio station where careful consideration is given for a person not to be deported.  “Where an individual is a bread earner for a family, particularly young children; and the reason why we give careful consideration to such cases is because the young in the BVI sometimes do suffer from inadequate parenting, and if a mother or a father is removed from the family arrangement, the young independent children can suffer from that, so where the young children involved and the father has proven himself to be a good attentive hands-on  father trying to do his best as a parent for young children and may have transgressed and found himself in Her Majesty’s Prison, then in those cases we will think carefully whether the balance of interest is not in keeping the individual in the BVI so as to ensure that the children don’t suffer unnecessarily from his absence,” he explained.

The governor, when asked by the radio reporter, if what would happen in a case whereby the person, a business man, spent most of his life in the BVI and would have contributed to national development, he responded: “I think you are trying to point me to a particular case and I will not be drawn by that.”

The governor was also asked if this was one of the areas ever looked into, and he told the reporter:  “nothing is excluded but as I said it is not normal”.

The letter to the governor reads:

Mr. Alphonso was convicted of a serious crime and served 4 year. He harboured fugitives Andrew Milton, Dennis Campbell and Christopher Bailey ‘murdered’, three Jamaicans who were wanted in the Territory for the murder of Dorcas Rhule. It is also alleged that Mr. Alphonso brought these men into the BVI with the intention of committing criminal activities. Mr. Elton Lennard owner of Bobby’s Supermarket and a well respected BVIlander was a constant target of the Jamaican Treo. Customers of Bobby’s experienced the wrath of these three gun wielding tugs on several occasions; as they too became victims of the robbers as they shopped at the supermarket.

Mr. Alphonso recently stood trial for the murder of Christopher Bailey. While Mr. Alphonso was found not guilty; he was found guilty for another crime and served 4 years.  BVI law states, if a person who is not a BVIlander commits a crime and is convicted that person upon recommendation or not is deported back to his/her home country.

….. Nonetheless I submit this letter as a petition that ‘he must go’. This letter is being sent to your and the Chief Immigration Officer for consideration.

I beseech you Governor Pearey, help us send a clear message to those among us with criminal intent; a strong message that ‘we will no longer reward bad behaviour in our Territory’.

I am asking that they too join with me and send letters of recommendation.   If we as a people do not stand up against the messes that are taking place in our Territory nothing will ever change. It takes ALL of us to take back this country from the hands of those who aim to destroy it. If we continue to turn a blind eye we will all have to continue to live with the consequences.

    If the law indicates that he should be deported then it should be done. People are fully aware of the consequences of breaking the law and when they do they should also accept the punishment. This individaual was punished for his crime and if deportation is what should happen after he has served his sentence then it must be done. No man or woman should be above the law.

    If he was living in the USA he could have lived there from he was 2 days old and commited a felony he would have been deported back to his country of origin. I have know of many such cases in the USA expecially since 911.

    People should know that citizenship to any country if you are not a Native is a privilege not a right and one should all ways be cognizant of that fact and live accordingly. When he became a convicted felon he gave up his right to citizenship.

      DA must be deported… It is the Law of the land… Immigration musty deport DA,, otherwise will set a precedent for other criminals. Immigration,,, do you hear that…. DA must be deported or will set a new precendent.. for other criminals to stay here.

      Attorney Daniels is simply stalling.

      DA was convicted of very serious crimes,,, and additonally , was planning larger crimes… This is a fact.

      Is this the type of person we want here in the law abiding Virgin Islands ??? That is the question.

      DA has had every opportunity given to him by this community and he repays this fine community with crime.

    I think the article missed something important i.e. the fact that Mr. Alphonso’s Deportation Order stemmed not from the acquittal on the charge of murder but from the conviction for, aiding and abetting murder after the fact for which he was sentenced to 4 yrs imprisonment.

    For someone who was not following the whole saga (eg. blogger Tourist) from the article it might appear that Mr. Alphonso is being subjected to deportation even though found “not guilty” by the courts. Such a scenario would, in my opinion, be wholly unfair but is certainly the case with Mr. Alphonso.

    @ blogger TOURIST: Since you’re such an apt internet researcher I urge you to use your researching skills to ascertain what the USA and most other countries do with non-citizens once they’ve been convicted of a serious crime and have served their sentence.

      Ummmm, I know the conviction is mentioned in the article, but I think it could have been mentioned at the outset instead of the acquittal since the Deportation Order by law would have arisen from the conviction rather than the acquittal.

      Don’t be an idiot. This deportation order has nothing to do with the murder charge. It is to do with his conviction and ultimate incarceration for harbouring the murderers of Docas Rhule. Why don’t you read and make sure you fully understand before you write foolishness in your comments?

      Because Dj Casual was found guilty by the legal system, DA wasn’t. If you or anyone else by opinion feels that he is guilty, that wouldn’t change what the law’s final verdict was. I’m not proclaiming his guilt or innocence, all I’m saying is that the law would have to over turn to legally deport him.

      The people that want DA to leave has little to do with it. The premier’s letter is the one that counted. In BVI Law, Guyana Law, UK Law, once a person was not born there if they commit a crime they have to be sent back home. That is no one hating on him there is no one doing wickeness that is obeying the laws that uphold and give to the civility of the land so lunatics like you can live in them and post BS. If you really want to get technical in Guyana they seize your assets and use them to help pay for your deporation and housing in the prison until you are dispatched and yes this has been done for years. But I don’t remember hearing your cries against Guyana doing that to other Caribbean nationals. wonder why??       The questions you ask should be directed at DA. For example, how does he feel to have broken the laws of the country that looked out after him since he left his birthplace? How can he sleep at nights when he has the kind of information that he has in his head? Furthermore, as a human being, how can he look himself in the mirror knowing the things that he has done? So don’t come on here with your crap, posting under different names and rewording because we see straight through you. YOUR DA should have thought about all those things before he did his act. He didn’t and his fate will be the same as others who were deported, with no exceptions.

    Most of these forums that allow readers to comment are filled with junk, ignorance and are an embarrassment to the country. They should be discontinued. Some get kicks out of reading and others develop a different (bad) view of the islands and islanders from the display of ignorance, prejudices and chaos seen here. One might argue freedom of speech but the line has to be drawn somewhere. These forums are a privilege not a right and the editors should be more responsible and know when to shut it down.
    Two more things:
    The world can see your comments; it doesn’t hurt to spell check if you are unsure about your spelling.
    In my opinion writing in dialect is NOT acceptable.

      Well said, I was in the process of creating a post stating what you said, some news stories, should be just that with out an area for comments. The publishers of these online papers should know where to draw the line, however like everything else where money is involved you will find little concern for society.

        Hot air. I strongly disagree with you both. I am always fascinated by people with your views, who advocate censorship and scream shut it down…they are embarrassing the country. That’s an elitist stance based on the ridiculous that posts on a public forum somehow translates to national shame. Why should anyone be ashamed of anything written here or elsewhere? I can understand not agreeing to them, but shame? People have a right to express their opinions even if we do not agree, and they should not silenced.

        I disagree that these forums are “filled with junk, ignorance and are an embarrassment to the country.” Sure, some of the views expressed on these forums, I do not agree with, but the beauty of the forums is that anyone with a contrary view can express his/her thoughts. Just as you both exercised your right to your view, so should others so long as we are within the posting policies.

        These forums have given ordinary B.V.Islanders a venue to express themselves. What you advocate is for the publishers of these sites to just post bland articles without discussion. We should all read and shut up. Well..sorry,,,that’s not how this part of the world works. Furthermore, I would suggest to you that no one will visit these sites if they were just bland without the ability to have an interactive discussion. It’s what’s keeps people engaged and coming back.

        The views expressed on these forums are a true cross section of the people of the B.V.Islands whether I or anyone else like it or not. Some are well written, others not so well and are in broken English or dialect. I personally have difficulty understanding the ones written in dialect but when they do pose such a challenge, I just keep moving. You guys are on your won. I share no collective shame for other peoples thought processes or views. Not because some post may not be expressed or written in a manner to my liking means that these posters should not have voice and should be silenced.

        Surely, if one wishes for more effective communication, I would suggest they use the Queens English & spell check, but hey….this is not an English class. Bottom line is this: No one should be ashamed of anything that is written on these forums, and these forums serve as a way for all those who are interested in sharing their thoughts whether their grammar, English skills, or opinions is less than desired to express themselves. Their voices should not be silenced; rather they should be heard just as yours is being heard, and not personal or national shame should be attributed to them. Forums are intended for an open discussion of ideas and thoughts. If you do not share a particular view or understand the writing, you have the choice as I do to respond with you’re your own thoughts or simply keep moving.

The tourist board should be ashamed because guess what yes the internet is powerful and Tortola depends on tourism and you try to lynch people there. My family has visited Tortola for years and stayed at Long Bay .There are blogs already started in the U. S as a result of your comments for future visitors. We also will not be coming back as our natives were rude to us.Your island will suffer the consequences of your hate and envy towards others. I feel sorry for whoever this DA person is but I have also read articles about the natives being rude and nasty to other Americans that visit . The Islands are breathtaking but to deal with the natives it is not worth it. Revamp your attitudes or suffer.

          My Questions what about Americans and others living abroad? I mean I have lived in the U.S. and other countries and I don’t think Americans, or people from Canada or England are a walk in the park either. I think the different views that people display on the forum shows the uniqueness of the place, and hey why would the natives stop you from coming, if you have been here like you said you did then you would know that clearly not everyone acts as such. Another point I would like to bring to the table is even living in America lets go to just one state alone in the entire United States New York, tell me where would you see a myriad of people with smiley faces, and beautiful faces. So Please Mr/Ms. whomever you are before you start stereotyping yourself just as you have already condemned The Citizens of the British Virgin Islands to do, I would ask that you please look in your own backyard first before you start making these accusations. Oh as umm even though you don’t want to come here that is ok we respect your views about your personal choice for you and your family, however there are thousands more that are dying to come to the B.V.I. and those who have visited before we have already booked them again for their 5th,10th,20th visits so good luck on wherever you go!

Let’s not forget the 45 calibre pistol that was supplied by the noble business to those rascals for “protection” against what i don’t wish to know, but had it been in another country, they all would be dead. Let’s not forget the lengthy trial of these men for the muder of Dorcas, Let’s not forget bereaving father and mother of Dorcas Rhule, the innocent bystander who was supposed to be alive today enjoying her easter holidays. Let’s not forget that the BVI has a standard to maintain and not allow crips like DA to manipulate it and get away. What is good for the goose is surely good another goose. He looks like one anyhow. On another note, I think, if i can recall, and BVI news will correct me, that sometime ago a child mother was appealing for him to support his child. so if he was here and was not doing his fatherly duties, as this issue was raised accordign to the deportation order, it won’t be much of concern when he is deported.

            Yes in every country people migrate to make a better life…but you see this little place call Tola you all better wake up cause if you look around here most of these business that are prospering have some island connection…the men marry the island women cause those from here refuse to cook,wash, clean and be faithfull to them men and the womwn marry the men from the islands because most of them are very ambitous and very hard working…everyday they tear down island people and the majorityof people from here 30 and going coming home to ask them mother what they cook.go out and be independent and try to look on the positive side of life and maybe in the future the women will not have to run to st thomasand all over the place to have kids…they do that because they from here but think here has nothing to offer them….
