UPDATE: Tearful wife fails to persuade magistrate to drop assault charges against her husband

Despite the many excuses and tearful gesticulations made by Parbattie Ragnauth in her plead for the assault charge against her husband to be dropped, Magistrate Tamia Richards did not wane in her decision to have trial continue in the Magistrate’s Court on August 29.
Parbattie and her husband, Isaac Ragnauth, co-own the eatery Mala’s West Indian Delight, and appeared in court in April of this year following a fight which left Mr. Ragnauth facing the charge of assault occasioning actual bodily harm.
In court yesterday, Crown Counsel Janice Stoutt invited Mrs. Ragnauth to take the stand and address the court. However, Magistrate Richards announced that a trial was scheduled and that should be continued.
As attempts to take the virtual complainant’s (VC) evidence began, a tearful Mrs. Ragnauth announced: “I don´t want this trial. We have two children and it has taken a toll on them…I have moved on with my life. I don’t want it.”
Mrs. Ragnauth first claimed she couldn’t remember what she reported then when the Crown counsel offered to refresh her memory with the written statement she gave to the police, the witness said she didn’t have her eye glasses and could not read without it. When asked if her glasses was in her bag, or at her home, the VC said it was broken and she needed a new one.
The witness even tried to wiggle out of returning by saying that the first court date was inconvenient for her because she had to travel overseas to deal with a matter involving her mother. However, the court decided on a date of October 16 before she left.
Magistrate Richards, who patiently listened to Mrs. Ragnauth’s excuses, and finally her breakdown about not wanting the trial, said: “It’s not what you want.”
The matter was later adjourned after Mr. Ragnauth’s attorney Mary Lou Creque pointed out that disclosure was not made to her. However before the matter was adjourned, the magistrate told the VC that she is to hold no discussion about her evidence with anyone. Richards told Mrs. Ragnauth that discussion of her evidence can result in an offence called “perversion of justice,” and the magistrate opined that she hopes the DPP’s Office will act if light is spread of this.
In his first appearance on May 29, Guyanese Ragnauth, 45, who allegedly assaulted his wife at their business on April 30, was granted $45,000 bail signed with one surety.
According to the prosecution, the virtual complainant (VC) and the defendant are married but have been separated; they own a restaurant in Baughers Bay.
It was stated that on the day of the incident at about 15:10, the VC was at her place of work handling a grocery list her husband had left for her.
She allegedly contacted her husband and had a conversation about expenditure of money for the business. The defendant returned to the place of business and met the VC at the back of the establishment and they had a further conversation.
An argument ensued and as a result, the defendant went to the backroom where surveillance monitors are located and where he also sleeps. The defendant told the VC that she should not enter the room but she informed him that she has as much right to the room since she pays the rent.
The defendant allegedly pushed the VC in the chest and she pushed him back. He then began to hit her in the head with his fist repeatedly and she held on to his neck. The defendant pushed her in the chest and she fell on the bed and the VC tried to free herself. She kicked him in the right knee, and after that the defendant left the room.
The VC sustained injuries to her right arm, back of neck and head, and made a report to the Road Town Police Station. She was sent to Peebles Hospital for treatment.
The defendant later went to the Road Town Police Station and was informed of the report that his wife had against him. He also requested medical attention, but refused to give police an interview.
The defendant was ordered to surrender his travel documents and report to the Road Town Police Station every Monday, Wednesday and Friday.

I agree. Although I think men that hit women are disgusting creatures, I also know there are many women who instigate physical fights and hit with blows of the fists and verbal missiles. Each and every one of us has been involved in a nasty dispute with the gender of the opposite sex. Whether it be a spouse or an ex boyfriend/girlfriend we’ve all been in situations where things have gone sour and tempers flare up. I am therefore appalled that people always jump in when nationalities are mentioned and the first thing is to send them packing. Obviously, if this man and woman have a business here then they’ve lived in the BVI for quite some time and contribute to the local economy. They have a fight that went over the top and everyone saying they should go home?? How many arguments have they had with their spouse? Yes, the fists came out and that is wrong, but it sounds like a woman nagging and egging on the man until he snapped. Take note that the man sleeps in the back room at the business!!! That’s his private place. She obviously resides in their home with their children and I bet she wouldn’t want him barging into her residence or her bedroom. All I am saying is stop pulling the racist remarks and suggesting people that live here and make it there home be sent away because they are experiencing problems in their relationship. I have been to court before and the magistrate did even want to hear from me because I am a man and she is a woman… I am not saying about what happened in this case, but guys do not go to court..trust me…it is on the womens side.. I was being setup and could not do anything about.. Ladys if you want to go..just say so..no need for mud slinging..
