BAIL DENIED

Bail was denied to Franklyn Malone, the 54-year-old BVIslander who allegedly threatened to kill his ex-girlfriend and feed her body to the fishes.

Prior to Malone being remanded to prison, it was also alleged that the defendant had threatened to turn on the gas and blow up the apartment. The complainant later got home to see her stove on and smell strong gas in her apartment.

Senior Magistrate Valerie Stephens told the court that on Monday an ambulance turned up at the court because the complainant was having an attack attributed to fear of the defendant. The court heard that the complainant has heart problems and that the fear from the situation is making things difficult for her.

The magistrate noted that the court heard that the defendant had threatened the complainant on more than one occasion and noted that the allegations are serious.

The court also heard that the complainant had moved from Tortola to Virgin Gorda to get away from the defendant, who moved there too, and continued to show up unexpectedly at her apartment – and would break in at times.

The defendant’s attorney Herbert McKenzie said the allegations are a matter of he said she said, stating that the instructions from his client differed from the allegations laid out by the Crown. The attorney said his client does share an apartment with the complainant and that the defendant discovered that his jewelry and passport are missing which is one of the causes of the problem.

Malone first appeared at the Magistrates Court on April 2 to answer to the charges of two counts of criminal damage and one count of threats to kill. He pleaded not guilty to all of the charges.

It is alleged that the defendant resides in Virgin Gorda and so does his ex-girlfriend, the complainant. The court heard that although the relationship between the defendant and the complainant had ended the two still shared an apartment. It was stated that the two had lived in Tortola together in 2006 but the complainant moved to Virgin Gorda and the defendant continued to visit unexpectedly.

It is alleged that on March 27, 2012, the complainant asked the defendant to leave her apartment and she placed new locks on her door. On March 28, the complainant and the defendant had an altercation and he threatened to kill and feed her body to the fishes.

On March 29, the VC left her apartment uninhabited and went to the doctor. While she was at the doctor she realized that she had left her money at home. She returned home and met the defendant prying her window and door. The VC made a report to the Virgin Gorda Police Station. When the complainant was making her report, Malone called her and she placed the call on speaker and the defendant was heard by police saying: “If Immigration don’t put you out I will kill you.” The defendant also allegedly announced that he was at the defendant’s home damaging the locks.

When the VC returned home, she found her gas stove on and said that there was a strong smell of gas. It was reported that the front door window was pried open and the back lock was broken.

While at home she also received a phone call from the Immigration Department, and it was reported that the defendant went to the Immigration Department and made a report of a missing passport.  While there he told officers that if he didn’t get his passport he was going to kill the complainant.

The defendant later denied making the threats and was subsequently arrested.

    Some women do not feel loved and deservving unless they are in conflict and on the edge of being killed by one or another man. They are just as bad as their abuser,worse than the man really. So they provoke andd play victim. Taking his passport and jewelry is for she to make sure he will show up so the drama start and she becomes a star.

    If she really want to be away rom him, then she should take a one way flight to Jamaica or some other Island where she could get the licks she seem to crave with a shrug o the shoulder from law enforcement.

    You all think this thing is a joke. If you want to know who this man really is go back to 1994. I hope the authorities at the prison watching him and could handle him. People usually say things on a ‘wim’ or when they upset but this is BODY you all talking bout. Hope this case is taken seriously.

    All I’m going to say concerning this situation is not to take it lightly at all. This is way beyond passport, phone calls and who is wrong or right,when an ex-lover threathens the other individual it should not be take for granted whether it’s a man or a woman doing the threats. This man needs to be watched carefully and monitered.

      You cant be this stupid? Are you blaming the victim, because she no longer wanted to be a victim? really? and she asked him to leave, and he obviously refused or she wouldnt have bothered to change the locks. Furthermore, if the lease was in her name, she had every right to ask him to leave, because like it or not, paying bills or not, it is her appartment and she no longer wanted to co-habitate with him. And really, if they were just roommates at the end, what the devil does his contributing has to do with it, he has to contribute, they are roommates he has to pay to live there too, but, it still does not negate the fact that if it was her apartment via the lease, she had the right to ask him to leave

      The onus was on him to grow a pair, have some pride and leave with his dignity, not threaten to kill her and feed her to fishes (watching to much mob stories for sure right there) and as for her setting him up, he set himself up by his behaviour. Men has just got to learn to let it go and let her go if she doesnt want to be with you anymore or be around you…..go look for the other other fish in the sea…there are plenty!

      Provoke men? Men provoke women too but most of the time we dont act like nut jobs about it and end up in jail.

      this is why domestic volience is prevalent here, because we blame the victim too much and excuse, dumb BS propogated by the victimizer!! Urgh!

        Not taking sides but if she wanted him to leave, why did she hide or keep his passport and jewelry? Some women dont know how to let go. She saying she’s finished, but still holding on to his stuff smh.

    Does this guy have a history of abuse? Does this woman have a work permit? Is she on his time and wants to make up a story so she get a new work permit? If he is really crazy and abusive well cool…he needs to be locked up.

    To the blogger who talks about hear say.This ois the 21st century.It is easy to check the phone records of both the caller and the receiver to verify if the call was made and the whereabouts of the caller when the call was made.If it is a cell phone there is technology to show geographically where the phone was that made the call.

    These men do not fear the law.They get light sentences when they kill or abuse innocent women.The fact that the police was able to hear him say on speaker phone that he will kill the woman and feed her to the fish is very serious and should not be taken lightly.Why put him on bail when the woman life is in danger. I hope justice prevail. Also this woman should receive counselling support from the gender affairs unit.

    Well I can tell you….Murder seems to be the new trend now. It seems like that’s the way to settle every dispute between two people. back in the days only sickness, accidents, and old age used to kill with an occasional murder every 10 yrs or so. Now, a person will kill you just for bad-mind and ain’t afraid to do it regardless of who and where you are at the time. What could be missing in man’s life that causes him to be so blood-thirsty? Could it be that the books of laws needs to be re-written?

    what im giving her wrong for, is she should not have continued to cohabitate with him. She is playing with his emotion. that is leading him in the wrong direction he thinking that they are still a couple. She should learn from that one young man that just hurt that innocent young lady over the same thing, Why dont they wake up and be alert! ladies learn and learn and learn watch from others misfortune please dont be another statistic.

      I’ve been in that situaion where an ex just kept runing up and trying to push himself on you and while its easy to write it really is not that simple to make him go away – until pushed to the point of your own safety and calling the police.

      Is that why men from St. Vincent chop you up and drink gramazon, Jamaican men shoot you up, Is that why in 2011 the Grenadian Ministry of Social Affairs indicated that “pervasive” sexual violence against women and girls in Grenada is “underpinned by widespread sexual harassment. Is that why Commissioner Walwyn in St. Kitts had to hold a press conference in December of 2011 to address the high domestic violence rates there and state that they are trying to address it? Keep you all hog mouth off the BVI. Some of the men are awful yes but we are no worse than the places you all haul yourselves up from. Last I checked we had several issues this year involving violence against women in the BVI and of the 5 cases 4 of them were not from here they were from Dominica, Anguilla etc… so please….

    I am surprised by the actions of these men, and I use the terminology “men” loosely. What is this trend of treating women as less than human beings and more as possessions/chattel? What’s more is the in your face cheating that most of these men practice. Men leaving their wife or house partner home while out wooing another girl or two. Yet when the main woman tires of their boyish behaviour and moves on in her own interest the men cannot handle the rejection and strike out. It is despicable behaviour. Selfish little boys wanting it all until they discover they really can’t have their cake and eat it too. Listen, if you guys had behaved like men in the first place and respected your relationship and committed yourself to loving one women then you would not find yourself being dumped by the woman you failed miserably at loving. Get your act together and learn to respect women. It’s hard to believe any of you have mothers or sisters.

    Sounds like another low self-esteem, crazy, jilted, and dangerous lover who is not thinking straight & would possibly kill his ex simply because the relationship is over or she possible took his passport which makes no sense to me as she cannot use it. This is simply outrageous. A young lady was just buried a few days ago with a similar nonsense, now this. This guy obviously has not gotten the memo.

    The thinking with some of these guys is this: if they cannot have their way with a woman nor have her solely, they would rather see her dead than to be with someone else. In this case, this one would rather have her thrown out of the country, or kill her and feed her to fish.

    What I don’t understand here is this:

    1. Why did they continue to live together initially after they supposedly called it quits? Sounds like a recipe for disaster. You are either done or you a not done. If you don’t want to use the bathroom, kindly get off the pot.

    2. Why he was he not charged with attempted murder? Sounds to me leaving the stove on were indented to kill, or at least burn the apartment down. I guess they could not prove he was the one who left the stove on given the absence of charge, but given this guys threats, who else could have done such a thing?

    The bottom line for me is this: people need to move the hell on when a relationship ends. There are more fish in the sea.

    Good the magistrate saw fit to remand him until a further court hearing. He sounds like a ticking time bomb who potentially poses a danger to this woman. The last thing we need to hear about is another jilted lover killing his ex.

    Move on guys when your relationship ends. Yes, it hurts; but you will survive. You don’t own anyone, and it should not be that serious. People (both sexes) should be mindful of the character they pick up and call a lover. There are always red flags if one cares to look.

        Not much hearsay when the police actually heard the defendant making threats over the complainants’ phone on speaker. It’s doubtful short of some other probable cause he would have been arrested if the police did not in fact hear the threat themselves. As per this report, he clearly denied having done so which was an apparent lie. Lots of folks who do this will swear by God they did not do anything unless it could be proven otherwise. The woman was smart to put him on speaker in the presence of the police.
