Kabasha Martin who is accused of assaulting two police officers in 2009 after he was accosted for allegedly smoking marijuana in Club Diplomat was ordered in court today, May 24 to pay a series of fines totalling $2,850.
On November 16, 2011, Martin pleaded guilty to indecent language, two counts of assault on a police officer, resisting arrest and disorderly conduct.
Before handing down her sentence, Magistrate Richards announced that she took into consideration the submission that was made by Martin’s attorney, Mary Lou Creque with regards to the fact that the defendant was young 22 years old at the time. However, she said that the court takes into consideration the aggravating factor that the matter started in the Club, in the public and indecent language was used on officers who were carrying out their duty.
In the end the defendant was fined: $600 for the two counts of indecent language ($300 or 30 days imprisonment for each), $1000 or two months in prison for one count of assault on police, $750 or two months in prison for another count of assault on police, and $500 or two months for resisting arrest, $300 or 30 days in prison for indecent language. He was reprimanded and discharged for the offence of disorderly conduct.
It is alleged that on October 18, 2009 at about 4:40 am, an off-duty police officer was working as a security guard at Club Diplomat Night Club in Long Bush when he observed Martin smoking. As a result of what the officer suspected he was smoking, he immediately called for assistance at the Road Town Police Station.
Two police officers then arrived at the club and met Martin, a father of two children, at the rear door of the establishment. There, the officers informed him of the report and cautioned him, however, he replied, “Why ayo police come here for? Carry ayo mother &$$%s…”
Martin then shoved one of the officers and ran away. The officers gave chase behind Martin and caught up with him in the vicinity of the softball field.
Martin allegedly began to resist both officers and a struggle ensued. He was subdued and taken to the police station.
