Cecil Marsham, who allegedly started a fight on his birthday and got his arm fractured in the act, was placed on $30,000 bail signed with one surety when he appeared in the Magistrate’s Court on May 29.

Both Marsham and Kevin Stoddart, the man he fought with, stood in the defence box with bandages on various parts of their bodies as separate charges were put to them.

The charge against Stoddart of inflicting grievous bodily harm is an indictable one so he was not required to plea. Marsham on the other hand pleaded not guilty to the charge of assault occasioning actual bodily harm that was read to him.

Crown Counsel Janice Stoutt told the court that police responded to a report of assault on May 25 at about 11 pm in Baughers Bay, and upon arrival met both defendants.

Marsham told the police that at about 10:30 pm he was coming down the road and stopped by a mango tree to ask Stoddart a question, and Stoddart chopped him. Marsham said he asked Stoddart “what happen” and Stoddart took up a 2×4 and lashed him across his hand and hit him in his head.

Stoddart, on the other hand, stated that he was sitting under the mango tree and Marsham was walking down the road, apparently drunk. He said Marsham was cursing, and when he approached where Stoddart was sitting, he said: “All you young boys feel that all you bad.”

Stoddart told police that at that point he got up and walked away because it appeared to him that the other defendant was looking for trouble. However it was stated that when Stoddart turned his back he felt a burning to the back of his neck and when he touched the spot there was blood.

He told police: “I was so upset that I just take a piece of wood from the ground and hit him with it across he hand and he fell. I never trouble this man.”

Both were taken to Peebles Hospital. Stoddart was treated for abrasions and Marsham for a fractured hand.

Marsham’s matter was adjourned to July 20.

Stoddart was granted $45,000 signed bail, and like Marsham, was ordered to surrender travel documents and report to Road Town Police Station every Monday, Wednesday, and Saturday.

Stoddard will be returning to court on July 26.

    who this man marsham trouble no one and even when he drinks still trouble no one read and think about the case dont make any sense the police and stoddard seems to be working together cause the info is incorrect,stoddard try to kill the man for no reason at all on his birthday at that now do u really think a man will look to fight on his bday you are talking pure madness. anyhow the truth will reveal strike not a man withot a cause.marsham may god guide and protect you from evil

    that Marsham always troubling pple when he drunk- the police should’ve taken a blood alcohol test on scene.He too old to be acting crazy.
