Gary Lester Evans gets 12 months in prison; doctors’ testimonies helped

Before sentencing Gary Lester Evans to 12 months in prison, Magistrate Tamia Richards noted that testimonies given by doctors Marjorie Yee-Sing and Heskith Vanterpool have caused the court to be lenient in sentencing the defendant.

However the magistrate said the court taking Evans’ illness into consideration did not mean the defendant should get a free pass. The magistrate said the maximum penalty for such an offense is five years imprisonment, and explained that in coming up with the sentence, she took into consideration the defendant’s age, ill health and his previous good character.

Richards said court’s task is to weigh the aggravating and mitigating factors and noted the points raised by Dr. Yee-Sing regarding the things that will make the defendant comfortable while incarcerated.

She said that the court was satisfied that the housing of the defendant at the prison was not impractical or impossible and that it was up to the prison authority to put things in place while pointing out she will inform them of the long list.

“I don’t know what would have driven a formerly good character individual like Mr. Evans to do what he did on June 4 2010… but he should have known better,” the magistrate said as she recapped the facts of the case.

In recalling the facts, the magistrate said that on June 4, 2010 the virtual complainant (VC) was on campus at the Elmore Stoutt High School after 5 pm when she was asked by a lady, who she did not know, to take a letter to Evans. She said she entered the class and left the letter next to the defendant’s computer.

The VC and the defendant had a conversation about how her schooling was going. He left where he was sitting, took her hand and led her to the chair she sat in while she was in his class. Sitting on a stool the defendant tried to make the young lady, who was sitting in front of him, sit on his lap but she got up. He is said to have first touched her on her hip, then on her breast over her clothes.

He also touched her private part over her clothes while saying nothing. The VC tried to escape but couldn’t. He tried to lift up her skirt and got it half way up but she tried to cut him with a piece of metal she had in her hand; she was then able to free herself. The VC complained to a teacher she trusted and a meeting with the defendant, the VC, the principal and the VC’s parent was later held, and the defendant was asked to write a statement.

The magistrate said Stanley Bernhard, a teacher, and Meade Malone, a friend of Evans, both testified of Evan’s good character and said that they were shocked to hear of his conviction.

It was announced that Duane Jean Baptiste, who was at the time Evan’s attorney, told the court his client was not a monster and that although he did not have any children of his own, had played a big role in the raising of his nieces.

PREVIOUS STORY

At 1 p.m. today, February 20, Magistrate Tamia Richards dismissed an application made by Dr. J.S. Archibald Q.C. for the matter against his client Gary Lester Evans to be transferred to the High Court immediately.

Prior to making the application, the seasoned lawyer told Magistrate Tamia Richards that the State would be responsible should Gary Lester Evans die at Balsams Ghut Prison.

Dr. Archibald said the doctors’ evidence are crucial and the risk of death, should Evans be incarcerated at Balsams Ghut, is a real one. He said both Doctors Marjorie Yee-Sing and Heskith Vanterpool testified that the prison facilities are inadequate to deal with the emergencies that will come as a result of said incarceration.

Dr. Archibald therefore referred to the Criminal Code and outlined other forms of punishments that could be considered in lieu of incarceration stating: “This is a man whose hands and feet are deformed; the miracle is that he is still alive.”

Further, Dr. Archibald said the Superintendent of Her Majesty’s Prison was consulted by Dr. Vanterpool and was informed that if Evans goes to prison and dies there the state will be responsible for his death.

The lawyer made various submissions in relations to human rights and the constitutional rights of prisoners: “I submit that it would be inhumane by evidence given in this court by Dr. Yee-Sing and Vanterpool to send this man back to prison, a calamity of which there is no recompense. If he dies his family can sue but then a life would have been lost.”

“You will be inviting his death in respect to the deficiencies at Balsam Ghut. In assistance of the court I submit that Her Ladyship has a wide option. There is no case like this in the Caribbean. This should become the precedence… Your Ladyship is in a unique position to create precedence,” Dr. Archibald pleaded.

In the Magistrate’s Court this morning Dr. Archibald had asked that the matter be transferred to the High Court immediately citing a breach of Evans’ rights to maintain proper health.

However, Magistrate Richard dismissed the application for a High Court hearing, stating that she looked at the law that deals with the request and felt that Dr. Archibald’s request was premature.

The magistrate said imprisonment is not of itself a breach of a person’s rights. She said the defendant has been on remand since December and she has not had any evidence before her that dealt with health-related complaints.

STORY BELOW PUBLISHED LAST WEEK

Former Chief of General Staff and Head of Emergency at Peebles Hospital Dr. Marjorie Yee-Sing has testified that a number of equipment and items might be needed to keep a teacher, found guilty of indecently assaulting a 13-year-old student, in a semi-normal state if he is to be incarcerated.

Dr. Yee-Sing told the court that Gary Lester Evan’s hospital file is voluminous as it took her more than three hours to peruse and make a report.

The doctor disclosed that Evan has full blown sickle cell and has been frequenting the Peebles Hospital since he was five years old; he is now 53.  She said the defendant has chronic bone infection, which causes him to have ulcers repeatedly; gall stones, liver, kidney and heart problems.

Dr. Yee-Sing said Evans’ illness is very tricky and he has certain conditions that would need to be in place if he was to be incarcerated.

Evans might require a 24-hour medical staff to be available as time is crucial when he takes ill and the location of the prison might be an issue, the doctor testified.

Dr. Yee-Sing noted that the prison has a doctor who visits once a week as well as a nurse, but explained that she is not sure if the nurse is at the prison on a 24-hour basis. She said Evans might require a narcotic pain medication that will need to be locked up and the nurse would not be able to administer it without doctor’s orders, because if administered wrong, it could cause complications.

The doctor also said that Evans might require oxygen at times but the nurse would have to know how much to administer. She also said that even though some treatments can be started remotely they would have to be continued at the hospital.

In the past Evans has had extreme anaemia which is critical enough to cause organ failure and has had to have blood transfusion. She said that the prison would have to monitor him to ensure that he has fluids and to keep him hydrated, Dr. Yee-Singh explained.

The doctor illustrated how cold temperatures sometimes affect sicklers and suggested that based on the location of the prison it might be cold there sometimes and as such Evans should have warm baths and an electric blanket.

The doctor suggested a suction machine, dressing set for the ulcers, a number of medications, including general anaesthetics, special clothes  etc. She also asked that the court speak with Evan’s internist Dr. Ibrahim to determine how often they must meet; Dr. Yee-Singh opined that it might be every week or two weeks.

Senior Crown Counsel Christlyn Benjamin told the court following Dr. Yee-Sing’s testimony that the Crown cannot dispute or challenge in any way that Evans is a very sick man.

However, Magistrate Tamia Richards announced that she believes that government would provide for the care of any patient at the prison.

    For the folks saying Justice is served MUST REMEMBER Beyond a reasonable doubt is the highest standard of proof that must be met in any trial, what “evidence” was presented?
    Basically this boils down to a case of he said/she said with investigators having to fill in the blanks. Was the “lady, who she did not know”,that gave her the letter for Mr Evans called in to testify?
    Was the “letter” ever found & presented as evidence. I find it disturbing that a such a case could be built on hearsay and such flimsy evidence.

    That lil girl going pay cuz I know aint know way Mr.Evans did what she is accusing him. Any one who ever been in his class knows how flimsy he is, he was weak then (6years ago) n I am pretty sure he is weaker now. Just hold your head mr.evans God will see you through this.

    Good. Justice was served. This judgment strikes me as fair giving all things considered including Evans reported health issues which apparently did not prevent him from fondling that young student. People in authority should always be held to account when they abuse the trust placed in them.
    It is just terrible when a teacher crosses the line in this manner.

    By delivering this sentence, the magistrate has reaffirmed that illness in and of itself is no excuse to avoid a custodial sentence, and that is a good thing for our justice system. Now, for the remainder of his incarceration, the prison can do what they have to do to meet whatever purported medical need he has as it should be.

    Finally, that young lady needs to be applauded for having the courage to come forward and report what was done to her. I am sure it was not an easy thing for her to do, and I trust that she will be able to move on with her life in the healthiest mental state possible after this potentially life defining event.

    One auction I would like to ask Archibald is if his client was charged for murder would he still be coming with this “sick story” to avoid incarceration? This is a load of crap. The man is on remand since last year and he hasn’t passed on yet nor have I heard that all those treatments that the doctors spoke about being administered to him. He should just be sentence and if he dies in prison then that is what destiny had planned before he was born. I might sound cold but if you do the crime prepare yourself to do the crime.

    Is the government still soley responsible for the prisioner’s health care??
    Would they be responsible for the barage of medical treatments that this perp is have??
    Are we (taxpayers) prepared to foot this potentially expensive situation??
    If all the answers are yes then this perp have found the answer to all his trials ….Free healthcare untill he truly qualifies as a senior. Hmmmmm sounds like a plan!

    All I can say is that the megestrate is DAMMMMMMM SMART! well i’ve know her for sometime as well and personally if she continues along her current path she will become an exempulary BVI magestrate, however the good ones always move on as they services are put to use in other jurisdictions.

The magistrate found him guilty based on the facts presented. You trying to tarnish the girl’s reputation is not going to change that.       If it is true she has connections with the victims family, then it is a conflict of interest and she should have nothing to do with the case at all. Any possibility of doubt regarding fair justice being served should have been removed at all levels. No one with ties to either family should be involved with administering fair justice in this case currently before the court.

          If the case was tried in the High Court you all would have still found something to say. It’s no pleasing some of us when our family members do wrong. Mr Evans knows exactly what he did and that it was sexual in nature. He never denied touching the girl in fact he said he only hugged her around the waist, remember? Highly inappropriate behaviour from a teacher to a student.

    Why would a male teacher put his hands around the waist of a school girl if he didn’t have bad intentions? Isn’t that a bad touch that we teach our children about???

    I believe he did more than that hugging around the waist and for that he need to be punished. Sick or sick not.

      if that is so,99% of west indian men should be in prison at one time or the other. this is very unjust judgement. even if it were true mr evans groped a bit, that should serve as sex education for the young lady to learn in advance of what is in store in future. most men do this and most young girls like it too. otherwise they call the man anti-man etc. this is no justice at all. the man should be freed immedietly and compensated for disgracing him and his reputation.

      to feel how the young thing feels to touch. its the most pleasurable touch the girl felt as training for what is going to come later in life. you believe in lots of bull shi…. this is a false case. anyway you look at it , don’t bring in god and prayers-judiciary gone awry. your daughter will want it too as she grows up unless you want to lock up her thing with a chastity belt or similar thing to keep her chaste for ever. and it will be a crime on your part to deprive your daughter of little fun and learn before she is actually ready for it[jane –be honest…….. you never experienced any thing like this in your growing years and if you did not like it, you would have shoo shooed the guy and go about your business. this thing is taken too far beyond reasonable thinking. sorry for mr evans most unlucky justice wise.

      great crime? its at best should be treated as part of sex education given free[if it was true] plus women playing saintly where as truth is the opposite. except in cases where violence and weapons are used, there can’t be a rape. this thing comes no where to be a crime. this matter should not have come this far-to the courts. a little admonition to the girl could have sufficed. looks like school and courts have nothing much going. poor mr evans is the sacrifial goat

      Both Gary and the child are children of God and no one should be wishing ill will on either of them. Prayers for Gods grace and mercy would better serve both of them. Gary should be given a just and fair punishment for what he has been found guilty of. Yes his medical condition should be considered in where he will be sentenced to serve out his time. The fact is only 3 know what really happened in the room, and God is one of them. He also knows their hearts and their intentions. God let’s us go through trials, but he is always there. He never gives us more than we can bare and yes even pastors make mistakes and fall to temptations. But no soul is worthless. Pray that you never find yourself or love ones in the same situations. I pray for both families. God never gives up on us. Stop being judge and jury and count your own blessings. I personally hope he does not end up in an environment that could facilitate his death or complications to his health. God bless you all!

    Good that Magistrate Richards dismissed Dr. Archibald’s application for Evans. If you know that you have all these medical problems that could land you in jail where you could potentially die there, then you should seriously consider keeping your hands to your self, and not committing a crime.

    Those doctors that are advocating a non-custodial sentence, I wonder how much they are being paid.

    Prisoners die in prison all around the world every day. Nothing new about that. All the prison needs to do is to meet his medical needs. Get him whatever medical attention he will require, but he should serve his time no matter how litte, granted she should take his overall health into consideration if she decides to send him to Balsum Ghut.

    I abhor child molestors, pedophiles, and the like. They kill their victims for life emotionally. Enough of the delays. Off he goes. And someone please don’t give me that sympathy crap. I am not trying to hear it.

      Addenum:

      This notion that a person convicted of a crime can be too sick to be imprisoned is ridiculous. The precedent Dr. Archibald wanted would have been a terrible one, as it would have opened up the flood gates of similar claims in the future whereby people convicted of a crime will all of a sudden have every doctor they can buy and testify on their behalf as to how gravely ill they are come to court to do their bidding, and avoid punishment. Most prisons have an infirmary for sick prisoners. If Balsum Ghut does not have one, are have an inadequate one, they should get up to speed.

        Look, I have a family member right now up in Balsum Ghut for their sticky fingers. I am not one of those kind of family who look the other way and make excuses for any family members when they do wrong. We all know right from wrong. You get your self in trouble with the law, I still love you, but you I’m NOT going to excuse your behavior, and if a family member of mines get convicted of a crime, they will have to do their time if prescribed by law like everyone else. So, no..I will be singing the same tune family or not.

            Well, as I said, the judge should consider his illness in her eventual judgement. I am not being totally insensitive to his condition. What I am against is that he or anyone should avoid a custodial sentence simply because they may be ill. Could you imagine what consequences that will have for our justice system?

            The system has to find the right way to deal with people like Mr. Evans. To let them off from custodial sentences is not the right way to go, and would terrible for the pursuit of justice if people who are convicted of crimes, and would normally get a custodial sentence escape such punishment, because they argue in court they are too ill.

            That would perverse the course of justice in my view.

    I know Mr. Evans and I too have doubts about his guilt. I think he should be under house arrest, with exception to go to his doctor and hospital. He will die if he goes to prison, and he doesn’t deserve that.

      The government should way risks (i.e. outcomes, costs etc.) versus rewards in decision making. What purpose will it serve for ill person to be imprisoned? Take some time to learn about sickle cell. There are a lot of more serious complications, living with this condition, especially with full blown sickle cell, such as your organs failing and body parts having to be amputated.

      It weighs heavy on my heart to believe the allegations made. Molestation is not something that happens only once. If in fact he is guilty of these acts, there would be a tract record and others would have stepped forward to testify. All it takes is one courageous individual to stir those who think they were powerless.

      While attending the BVI High School, I was the only female in his class. At that time he was one of my well respected teachers. All my teachers were and the majority were males. The only thing teachers were guilty of then was really caring how we turned out. I recieve hugs from all my teachers when I see them now, because they were proud to see what I have become and that I remembered them. Did any of the attorney’s question Mr. Evan on the purpose of putting his hands around her? Did anyone draw notice to his physical strength and appearance? Do you think he would risk his career, in close proximity to retirement and in his physical condition? Take note to the current statement below,”I went to high school with him and he was out sick more then he attended school”. Another question to ask, how much were his medical expenses during that time or throughout the years working at the High School? Can the government give him the same level of comfort? Did the government in written form confirm that they are willing to take on these additional costs?

      Was a polygraph test used during the proceedings? There are rumors flooting about that he was set-up. Was it looked into? I question, why would a teacher send someone after school hours to hand him something. Why couldn’t is wait until the following day? Was a thorough investigation performed on all parties associated, to determine whether there were any prejudices or ill-feelings about one another and background or behaviour outside the school(personal traits). What kind of relationship did they have? Trusting, family ties etc.

      The way law is interpreted defines a person’s life. Whoever has mastered the art of persuasion always gets the results they desire.

      His term should be spent in the hospital and/or house arrest. The number of years he has served this community without any concerns, should be considered.

      I believe with the right evidence presented all truth would be in the open. There are two sides to every event, but I feel there are parts missing. I would like to know if there were any motives behind this act by all related parties.

      Are you God, to know that he’ll die if he goes to prison? He’ll be just fine up there. Now that he knows his fate, he will sit and reflect on where he went wrong, take his medication, do what the doctor orders and in no time flat he’ll be with his family again.

    He is indeed a sick man. I went to high school with him and he was out sick more than he attended school, but if he disrespected the student he should be held accountable. I dont think he should be in prison though, since he only touched her inappropriately. No intercourse was involved.

    That’s unfortunate Doc. But his physical illness does not excuse his crime. I figured it would be more beneficial for someone to speak of his mental incapacity… but this testimony only proves that he is more than likely guilty and fears the consequences to come. Why should that be the concern of the court???

If anyting happen to yo up there they tell yo is gas. I hear dis person make a complain a time, and d medical people say is gas. When it ain’t go away dey say tek “Dica”. When da ain’t wok they say go to d hospital only 2 find a rupture had happen in dey stomach. This person always in and out d hospital and nobody saying nothin.

    If Evans go up there, I ain’t feel dey goin get no machine up there fo he. So da goin b like a death sentence. I hear de nurse dem don even b up there everyday.

      This man was convicted of a crime. Can we afford to cater to all the conditions of each prisoner on the spot. I agree with Ms. Richards, the Government should set up a clinic in the prison to deal with conditions as they arise. They will not ignore his basic human rights, leave Ms. Richards alone.
