Independent probe into fatal shooting of prison escapee

An independent law enforcement agency will be investigating the death of accused murderer and prison escapee Santo Hernandez, who local police shot in the Butu Mountain area of Tortola yesterday.

A media release from the Royal Virgin Islands Police Force (RVIPF) this afternoon said the decision was made to employ independent investigators after consultation with Governor Augustus Jaspert, who is responsible for the RVIPF.

The Royal Turks and Caicos Police Force has agreed to undertake the investigations and officers from that force will arrive in the territory tomorrow (8 December), the RVIPF said.

“This is an opportunity to offer the transparency needed for evaluating officers’ actions in this incident. We must be prepared to review our actions and allow others to do the same. This is a critical component to the service we provide to the public,” said Acting Police Commissioner Alwin James.

Hernandez was shot during a police operation.

Meanwhile, Hernandez, who is a native of the Dominican Republic, was one of three inmates that were still at large following a massive prison break after Hurricane Irma in September.

He was charged with the murder of Alston Penn, whose lifeless body was found in a pool of blood on the Windy Hill road in March this year.

    Excuse me but what the F_(k are they investigating for? The police did what they had to do.Go investigate who his clients are that was paying him to put hits on people.

      so that’s the kind of society u want to live in, where police can just kill people? Despite the guy’s crime it is important to investigate and make sure the police followed the proper rules. That’s how it should work in law abiding societies

        Listen he lived by the sword and die by it.
        There is nothing to investigate here. People in Tortola feel they we can get away with anything because you can sweet talk the police and politicians, well welcome to the real world.

        SCHUUUUUUUUUUUPPPPPSSSSSS Please go relax. He escaped prison. been on the run. had a gun and got aggressive with police and charged at them. He got shot and the end. If he was a model prisoner and he know he was innocent why didnt he turn himself in? Investigate what? Tell me.. You saying while he reportedly charged at them with his gun they should have waited and text the comissioner for permission to fire? They did their job and the country is very happy. This man is accused of killing one brother, and then the other gets murdered after his escaped – alleged for the court records. What about that sweet little girl? Naw man.

    How ones life turns out quite often comes down to the choices we make. From all that I have read, this guy was of questionable character. Now, Im not going to celebrate his death as he has family somewhere, however, I will not shed a tear either.

    Those who provided him with food and shelter need to be sought, and the two oustanding prisoners, if they are smart, they might want to walk into the nearest police station. Nuff said.

    ppl pls read the law. section 11 (3)of the Constitution and see what it says about ppl trying to engage or escape from the police or Her Majesty’s Arm Forces. Hope u understand what it says.

    Good move by the Commissioner. That is what you call accountability. Take notes NDP.

    Yes this was a bad man who escaped HMP but as bad as he was even he deserved some form of due process and for those who killed him to be accountable for their actions. Were their actions justified? Were they in immediate harm or danger when they killed him? Were proper procedures observed? For future cases we also do not want Police to kill civilians without requisite accountability so they must always have the potential of an independent investigation in their thoughts while on duty.

    Then there is the issue of whether he is more useful to the investigation being alive or dead? The former must be the case as even if he was not cooperating with the investigation, he may well implicate himself or others.

    Police services most everywhere have a special investigations unit that is responsible for investigating every incident that the police are involved in that results in death. Car chase, gun shooting, taser, beating, no matter the cause it is investigated. Even if the person committed suicide in police presence it is investigated. It’s done for accountability on many levels. It instills trust.

      Not even that he leaves the country ever so often and returns with no hassel. A friend goes to school here went off to school for a year and upon returning immigration gave him the pangs of hell. Remember he has exemption. He was even sent a message saying he must be off the island by the next week. No explanation. He fought and went to the ones over the immigration and is still here. So how comes these killers go and come as they please and remain? Those who trying to get a little education to return to build the bvi is shunned. Be careful people
