Fahie granted $1M bail after failed appeal by US prosecutors

Disgraced former Premier, Andrew Fahie.

Former Premier of the Virgin Islands, Andrew Fahie, was granted a new bail offer when he appeared in the South Florida Federal Court yesterday, May 23, after a judge struck down the United States prosecutors’ appeal against the initial bail offer he received in early May.

The federal court told BVI News on Tuesday that Fahie’s latest bail bond stands at one million dollars. This is double the $500,000 he was initially offered.

Fahie’s $1 million bond is divided into a $500,000 personal surety bond which can be co-signed by him, his daughters, and a friend and also a $500,000 corporate surety bond.

The Nebbia condition remains as Fahie must prove to the judge that the money for his bond comes from a legitimate source. Failure to do so will result in the suspension of the bond.

In addition, the condition of the bail requires Fahie to wear an ankle monitor and his defence attorney can only visit him at his daughters’ apartment in southwest Miami-Dade County. His family – daughters and wife – must also surrender their passports to United States officials. Fahie also cannot be found within close distance to any transportation centres including bus stops.

The United States prosecution had argued that Fahie should be held in lock-up until his trial because he was a flight risk. They also argued that he would be a danger to the community if he was released.

The former Premier is accused of attempted drug smuggling and money laundering along with the BVI Ports Authority Director Oleanvine Maynard and her son Kadeem Maynard. Oleanvine, represented by a court-appointed attorney, has declined to file for bail and has also invoked her rights to not be questioned by United States officials.

Meanwhile, Kadeem has not made an appearance in the Florida Court yet. He is currently being held in detention in Puerto Rico.

      No they not, stop spreading misinformation. Bail conditions are a normal procedure in Criminal Courts to ensure that the Defendant turns himself in.

        Wrong! “@hm” is absolutely correct. His past actions, and present actions in the BVI, that no one there seems to know anything about, except the Feds, and witnesses for the trial, factors in determining the terms for bail, the cost and also the many conditions he and his family must abide by. I worked for the Feds in 3 Miami, Florida Courthouses for many years. The defense attorneys and prosecuting attorneys are in separate buildings for a reason, but they are all friends or good acquaintances. All the judges were in my building and I had regular contact with all of them. If you are the fact-checker then you are misleading your people, outspoken without researching as many are these days. And you seemed so quick to attack her, that you did not read her comment correctly. Have a better day.

          Once again we have another person who is commenting wrong information. The bail conditions of a surety and a residence requirement are both common bail conditions. You cannot prove that someone is guilty or not guilty of a crime because of the bail conditions set out by the Court.

          Also, if the defense attorneys and prosecuting attorneys are such good friends as you have mentioned then the bail appeal by the Prosecution would have been successful.

          Additionally, the comment indicated that “bail conditions just proves you are guilty if anything”. If that was the case then the bail appeal by the Prosecution would have been successful and there wouldn’t be a need for trial and evidence to be presented. The Prosecution is the one that has the burden of proof and bail conditions do not prove whether someone is guilty or not guilty.

        I cannot get over those long sentences the US is calling for those charges when they have people selling children guns and they are gunning down innocent children in schools and they don’t get life in many cases. They need to deal with those issues they have as well. They are trying hard to prevent drugs from coming to America, but doing very little to prevent guns from getting into the schools. Just yesterday a punk killed 19 students and teachers in a school. How is that being allowed. Once was too much for this to happen.

    The US legal system allows bail a lot easier than the UK system.
    I don’t think he is a danger to society and with the restrictions they have on him including his family are very strict.
    He also is not allowed to pay 100k to bond out.
    50% has to be with a bondsman, which is 50k he has to cough up and no bondsman is going to stake 500k on someone they believe to be a flight risk from another country.
    For the other 500k they have to prove it came from legal sources.
    i.e. His daughters house. If she holds the mortgage in her name, they will look in to how she placed the down payment on the property and if daddy sent it to her, where did he get it?
    This is a tough bond and he will also be letting the government in to his personal financial records.
    Add the fact that the DEA will not let him out of their sight.
    A very tough bond that he might not be able to cover all conditions.

    His goose is still cooked though, unless they is someone he can give up and I think they are quite happy with what they have got.

    I know there are a lot of people on this island that will never visit the US again lol
    The family has to put up 550k, get a bondsman to belive them and stake half a million
