Fahie seeks relaxed bond conditions as trial draws near

Disgraced former Premier, Andrew Fahie

Former Premier Andrew Fahie has filed a motion before a Florida court to receive more flexible bond conditions ahead of his trial.

The former premier is facing charges of drug smuggling and money laundering along with his co-accused — former BVI Ports Authority Director Oleanvine Maynard and her son, Kadeem Maynard. The Maynards remain incarcerated ahead of the trio’s expected July trial.

In a document seen by BVI News that was filed by Fahie’s attorney, Theresa Van Vliet on Friday, April 7, Fahie petitioned the court to allow him to travel for dental appointments and increased visits to his lawyer. Van Vliet told the court that her motion was not opposed by the Prosecution.

Fahie currently has limited flexibility after a revised bail bond order only allowed him to travel for court appearances.

Conditions of the bond have meant his attorney has had to travel to his small two-bedroom apartment for client visits. But, the apartment is shared with his two daughters who are attending college. Van Vliet told the court that the size of Fahie’s residence makes confidential communication difficult, if not impossible, if either of his two daughters are at home.

Now with the trial fast approaching, the attorney told the court that even though she has been meeting at his apartment in Miami for visits since May 2022, the necessary preparation will be made much more difficult given that her office is located in Fort Lauderdale.

Fahie’s daughters sometimes leave the apartment when he has short meetings with his lawyer, but the attorney said requiring them to leave the premises for extended periods during trial preparation will be impossible given that they both attend school online.

She said trial preparation would be better served in an office replete with the necessary materials and resources, including the ability to speak freely and confidentially with his attorney.

Van Vliet said her client recently obtained permission to travel to his dentist for a root canal, and wanted additional modification on the bond order to allow for follow-up dental visits as well as attorney visits to her offices either in Miami during the trial or in Fort Lauderdale.

These visits, she explained, would be no more than three times per week, beginning around June 26, and continuing through the duration of the trial.

    Why did they took so long to ask for privacy and confidentiality? I see no reasons why this asking should be denied, or unless the judge see the request as freedom to do something else than what he is asking for. Will wait to hear more..

    What a tragedy driving from Ft. Lauderdale to south Miami to meet with the accused in a 2 bedroom apt.

    Put the accused back in prison NOW. No more driving and plenty of facilities for client/attorney meetings during the trial. Postpone the dental work until after the trial and sentencing when there will be plenty of time to save the prisoner’s teeth.

    My people, yes the Premier was in the wrong for allowing himself to be involved in this shameful scandal. However, don’t brand him as the most evil man on earth. Andrew did a lot for this territory and he loved his people dearly, he was a protector of the BVI and its people, he stand up against the Colonial Masters.
    Now lets take a look, Panama President Antonio Naragiah was a CIA, he went against the USA, they invade his country and arrested him on drugs charges. Many great and powerful man are in Jail for corruption and drugs. Why think Andrew should be a saint? Watch don’t render evil for your people. Think about it; How many of you in the BVI is better? I guess you didn’t get caught eh. Who more corrupt than the white Man. When a small country shows some form of independence they will find all ways to suppress the leaders and even kill or imprison them. For me I pity the former Premier for allowing himself to fall in a trap set by the UK and the USA. Just think of a man encouraging you to import drugs from him and the same man is working for the FBI. Isn’t that wicked? That’s how the USA behaves and you telling me Andrew is wrong. Do you know what is a good offer to be rich as a human. temptation? Smile on that and don’t play with the USA and they wickedness.     This paper has a predominantly expat readership and takes an anti-Fahie stance. Although some may disagree with my views, it is important to recognize that this is not a clear-cut case. The US legal system operates differently and, while I do not condone his actions, Fahie has only been accused and not convicted. Contrary to popular belief, this case is not receiving much attention in the US, even among Caribbean residents in Florida. The burden of proof lies with the prosecutor and there is room for reasonable doubt.The defendant does not need to prove innocence. If the aim was to bring Fahie down, then mission accomplished, but it is not implausible that he may be acquitted in a jury trial.

    @ @cynic. Not sure how someone who lacks any valid accomplishments can be a threat. Perhaps I am missing something here. What were the accomplishments that made OJ fit to advise the premier. If anything, wouldnt his post office programme be better suited to assist the ministry of communications and works? It is fishy. And considering the former was in the process of selecting his predecessor, was about to embark on the trade deal with the fake sinaloa cartel and was on his excursion to collect the money from the plane to seal the deal, it is obvious that head coach wanted to play and was aligning his team of crooks. Perhaps, he needed ** who may have established contacts during his post office programme in the areas of shipping in different countries/zones. Obviously, you would need to know who to work with to get the shipment of drugs from one port to another. That could be why he selected **, who have no accomplishments that is fit for the role to as much as advise a premier, instead of using the PS and some other senior staff to advise him in his premier-related duties instead. There are certainly other people who had relevant qualifications but it had to be under the guise of a legitimate advisor job to explain his relationship with and payments to **. Same way the empty barges would have served their purpose in the drug trafficking route and the Joe’s hill apartments would have served their purpose to be used for money laundering purposes or to house the frequent visitors from the fake cartel or other mentioned group, Allegedly.

    …and was only focused on enriching myself through a drug trafficking deal, I would need a few things.

    1) connections to someone in a bank in a high position that I can trust to overlook certain transactions, like a spouse.

    2) a post/shipping man. Someone who from their previous work has established connections around the world in the postal service and shipping industry so we can know where to direct the shipment from port to port and what time based on who is on shift.

    3) multiple projects through which I can launder the money example setting up a company to buy and sell some of the Joe’s hill properties to and from companies that are owned by myself or other questionable colleagues.

    4) connections with someone who can set up companies for me but through someone else who been paid under the disguise of contract work.

    …and the list goes on. Everything would run perfect once I don’t get caught.

    No. However, a jury trial could consist of Black Americans who havea history/experience of injustices from the court/legal system and may sympathize with Fahie. It is worth noting that the news cycle in the US is short, and this case may not be remembered for long. Additionally, there have been bigger cases involving politicians and more money in the US.

    I have criticized the former Premier’s politics where I deemed appropriate for years but IMO despite these allegations he did good also.

    His heart was in the right place when it comes to doing things for people and the country. Its unfortunate and tragic he finds himself in the position he is.

    He is not the first politician to get caught up in something like this. He will not be the last, and he did no worse allegedly than others.

    The US is filled with drugs. Always has and always will because the demand for drugs in the US is high. Despite high incarceration rates and severe punishment, the demand for drugs remains high.

    The Columbian and Mexican drug Lords know that much that’s why they prey on the vulnerable and seek out those who r poor, desperate, or desperate to facilitate getting drugs into the US at all cost.

    Bottom line: Lay off Mr. Fahies kids. They were not charged with any crimes. Let them get on with their life and studies which has to be very difficult for them. Criticizing their dad is fair game, but leave the mans kids alone. They have enough to deal with without people like you making it worse.

    Today is Easter Sunday. Reflect on your own sins and how u can be a better person. Go out there in the community and help the poor. Go to the schools and talk to kids about the dangers of using and selling drugs. Do more than gossip and wishing bad for others.

    Accept the fact that the ex premier will be convicted of conspiracy to import illegal drugs into the USA. He might achieve a shallow victory in the first trial but the US appeals court system is not designed to let criminals go free, especially alien criminals. The appeal process takes decades and sometimes ends with the US Supreme Court final decision by an assortment of judges. Either way he’ll spend the rest of this decade incarcerated and a good part of the next decade. Eventually he’ll be released around age 70, return to the BVI and spend his senior years contemplating his disgraced legacy to his country of birth. A sad ending to a sad life.

    If it was Dr Smith or Hon Penn of the NDP had put the country in such a turmoil .., having the suspension of our constitution hanging in the balance they would not have been able to come to the public with a team representing the BVI people
