Former Premier Fahie seeks bail variation for Christmas

Former Premier Andrew Fahie has filed an unopposed motion requesting a modification of his current bond conditions to allow his wife to retain travel documents during her upcoming visit to Miami for the holidays.

Fahie is currently on bond and confined to his daughters’ home in Miami, Florida as part of his $1 million bond conditions.

The former Premier was slapped with charges of drug smuggling, money laundering and racketeering and is facing life imprisonment if convicted on the allegations brought against him by the United States government.

The motion, submitted by Fahie’s atorney Theresa Van Vliet on December 11, outlines the background of the case, highlighting his initial arrest and the conditions set during the pretrial detention hearing.

The proposed modification seeks to permit Fahie’s wife to keep her travel documents during her holiday visit to Miami, citing the logistical challenges and time constraints involved in retrieving and handling these documents personally.

The motion emphasises that neither the government nor probation objects to the requested relief. Mrs Fahie’s visit is scheduled from December 15, 2023, to January 7, 2024, and the motion argues that allowing her to retain custody of her travel documents during this period would be more convenient for all parties involved.

Fahie’s co-accused — former BVI Ports Authority Director Oleanvine Pickering Maynard and her son, Kadeem Maynard — both pleaded guilty earlier this year to a single count each of drug trafficking in exchange for reduced charges and leniency from prosecutors.

Kadeem was recently sentenced to 57 months in prison. However, his mother Oleanvine is likely to testify in Fahie’s trial as part of her plea agreement and will be sentenced on January 18, 2024, just ten days after Fahie’s trial commences in earnest.

Van Vliet told the Herald previously that Fahie did not intend to seek a plea deal and wanted to fight the charges vigorously in court once his trial came up. Fahie’s trial date has experienced multiple delays because of difficulties arising from the substantial volume of evidence. Prosecutors have faced challenges in disclosing this extensive evidence to Fahie’s defence team.

    I was not a fan of Fahie but more and more I realize he was one of the few bold enough to fight for what was best for the majority of the people of the BVI and this irritated the powers to be as he stood in the way of their take over plot so at all cost they had to try to get rid of him and make it look as if their hands are clean.
