Governor assents to Public Service Management Act

The government announced via Facebook yesterday, November 18, that Governor Daniel Pruce has assented to the Public Service Management Act.

This new legislation aims to modernise and enhance the efficiency of the territory’s public service. The Act replaces the outdated General Orders from the early 1970s, which previously governed public service operations. Deputy Governor David Archer Jr highlighted the need for this change, stating that the old orders have been “put to rest” to make way for more contemporary policies guiding public service conduct.

Premier Dr Natalio Wheatley introduced the Public Service Management Bill to the House of Assembly in August, emphasising the necessity for greater accountability among public officials. He noted that the public service operates under the Governor, an unelected position, causing a “democratic deficit” and hindering effective service delivery.

Dr Wheatley argued that this structure limits efficiency and accountability, making it challenging to hold public servants responsible for their performance.

The Act outlines clear roles and responsibilities for ministers and senior public officers, including provisions for delegating functions and managing ministerial staff. It also established the Virgin Islands Public Service Learning Institute, which is dedicated to training and developing public officers to ensure they possess the necessary skills to perform their duties effectively.

The legislation sparked intense debate among lawmakers. Third District Representative Julian Fraser expressed concerns during the debate that the Act could expand the Deputy Governor’s role, potentially undermining ministerial authority. He warned that this could lead to an imbalance in power dynamics between elected officials and the Deputy Governor.
