It’s almost criminal! Malone slams UK Order in Council

Territorial At-Large Representative Carvin Malone has expressed disappointment at the prevailing uncertainty over the prospect of the BVI having general elections in the coming months.

Malone questioned why residents were constantly expressing scepticism over whether there would be general elections in the territory, despite an assurance from Premier Dr Natalio Wheatley.

According to Malone, an unjustifiable Order in Council hanging over the head of the BVI was the sole reason for this scepticism.

“It is not fair. It is almost criminal that folks should be wondering whether or not there will be an election as a result of the Order in Council that exists,” Malone said on his One VI Agenda radio programme.

Governor John Rankin previously noted that the Order in Council will be held in reserve in the United Kingdom (UK) to facilitate a suspension of the BVI’s constitution if the BVI were to renege on its commitment to implement agreed-upon Commission of Inquiry (COI) recommended reforms or if he assesses that progress on their implementation is being frustrated in any way.

“There’s no justification for it and it should not exist because I’m telling you, it has to be a violation of some world rule,” Malone said of the Order in Council.

Malone has insisted several times in the past that the BVI’s constitution will be suspended by the UK regardless of whether it complies with the agreed upon COI-recommended reforms.

He has since indicated that divine intervention will allow the BVI to stave off the enforcement of the Order in Council and keep its semi-autonomy.

“God has seen us through floods, hurricanes, the global pandemic, a Commission of Inquiry and will deliver us from an Order in Council,” Malone said in his New Year’s message.

In the meantime, Premier Wheatley has promised to seek the removal of the Order in Council when he meets with UK Overseas Territories Minister Lord Zac Goldsmith and other officials in the UK next week.

    What is “almost criminal” is this government’s dragging its heels on the commitments made to the UK government. Given this and previous government’s reneging on commitments the Order In Council is a necessary enforcement tool (otherwise known as a non-performance penalty), which the UK made clear would only be used if the conditions of the agreement (contract) weren’t acted upon in a timely manner. Stop this needless posturing and just follow through on the commitment made in writing to the UK Government!!

    The Governor must be made to make public what did he wrote in his document to the UK to get the Parliament in UK and the Privy Council to issue the Order in Council. Also ask him the same thing about the financial services with public registry where he has another pending order in council to force down our throats. Those two pieces of information and everything related to them needs to be made public. I am sure that in both it will reveal that the facts were massaged to fit their devious purpose. The people of the BVI need to know what was in those documents sent by the Governor so that they can have a fair and transparent opportunity to defend themselves. In a time of when the Governor and UK is calling for transparency, they have acted under a cloud of secrecy and deceit. This information must be known & known now. They should have no reason to keep this information private while they are using it to act publicly. This is our only hope of trying to put an end to these high handed actions.

    Enough dictatorship. You have all the below rejecting the UK dictatorship moves especially with the Order in Council for direct rule:
    1) The United Nations
    2) CARICOM
    3) USVI GOVERNOR
    4) OECS
    If all these were against actions of our public servants, local and Caribbean people and our politicians’ decisions and all of them kept moving forward regardless, the majority of us would have been hitting the ceiling if they failed to listen to them but we want to give the Governor and his UK Officials a free pass. It is time to end dictatorships of any kind. It is time to end colonialism. It is time to end the orders in council and their attempt at direct rule and at our financial services. It is WRONG! It is anti democracy.

    Malone what is criminal is people like you who brought this on the BVI, You all did your wrong and thought you will get away with now that you were caught you have all kind of things to say about the UK. Your X boss brought this down on the BVI. The UK should have taken us over for at least 2 years if they had done that we won’t have to listen to people like you. The Order in Council is needed because the UK knows that if they didn’t do something to keep the government in line nothing will change. I hope the UK keeps the pressure on.

    It’s very simple. The commitment forced by the UK should have been forced by the people of the BVI if they weren’t constantly shut down by politicians and had more power.

    The UK in this case is working for the people of the BVI to make sure that the promised changes (which we all wanted) come to fruition.

    What is almost criminal is the failure of the UK to drop the hammer on a territory they are responsible for, but which they have allowed to become institutionally corrupt and indeed criminal. Why have a CoI if everything will stay the same? It is a dereliction of duty.

    The UK is being very complacent about what is likely to happen here.

    No one is dragging their feet with the recommendations. It’s a process and requires time to assess and put forward the best policies that will be worthy of the people. Not something rush rush just to accommodate the slave master so like in the house in St. Vincent “Shut you blasted mouth!” talking for talking sake.

    Worse than what they are claiming happened in the BVI has happened in the UK but it is either swept under the rug or dealt with a hit on the wrist, but they never suspend their parliament nor otherwise. It is not democratic what the UK is doing and downright hypocritical.
