Man ordered to pay $106K for pit bull attack on pregnant woman

Not any of the actual dogs mentioned in the story.

The High Court has issued an award of $106,931.93 against Elmo Connor Jr in the matter of a Pit Bull attack that happened in Sea Cows Bay in 2019.

According to the facts of the case, the victim, who was pregnant at the time of the incident, returned home from work on December 17, 2019 and was attacked by four Pit Bull Terriers, owned by Connor.

The victim told police that she arrived at her apartment building just after 11:30 pm and was about to make her way up the stairs to her apartment that was on the third floor. Four pitbull dogs walked slowly up to her left side, and because she was scared and frightened at the sight of the dogs she froze, not knowing whether to continue to walk or to run.

The dogs then began to attack her, biting her about the body and she started crying for help and fell to the ground. When the dogs attacked, she tried to fend them off, but was unsuccessful and used her hands to cover her face, fearing that one of them might eventually get hold of it. One of the dogs eventually grabbed and injured her right ear.

The victim told police that she was just outside of the apartment where the defendant lives, and remembered seeing lights on in his apartment and hearing his daughter crying, but said no one came to her rescue. Despite the pain and burning from her injuries, she managed to get up and push her way to the balcony of another apartment, where another tenant later rescued her.

The victim told the court that she suffered extensive injury to her arms and legs, and was left with significant scarring. She also has permanent damage to the myelin sheath around the axons (nerves), particularly to her right leg and foot, which causes ongoing neuropathic pain.

Damages were claimed for pain, suffering, and loss of amenity — a sum in respect of the gratuitous care given by the victim’s aunt and her then fiancée. The dog attack victim also claimed for special damages and the ongoing cost of a drug prescribed for neuropathic pain, which she will have to take for the rest of her life.

In assessing the damages for pain, suffering and loss of amenity, Justice Adrian Jack held that damages should be divided into two parts. He ruled that the first was for compensating the shock and horror of the attack, and then the two month period of recovery; and the second part, for the lifetime pain and scarring that the victim suffered.

The defendant did not respond to the summons and did not make an appearance in court to defend the matter when it was called, court documents showed.

    Sorry this lady went thru such trauma. I wish the judgement was more. If he fails to pay, she should go after everything he owns until the judgement is satisfied.

    Many of these pit bull owners raise them to be aggressive. They need to be held accountable when their aggressively trained dogs injury people.

    Now, I trust all 4 dogs were put down and they are no longer alive to cause injury to another person.

    never appeared in court to defend himself so 2 questions:

    1) Is this judgment a summary judgment?
    2) If the defendant is absent how will the $106+k judgment be enforced?

    If the defendant has no assets in the BVI and fled the country enforcement seems unlikely.

    For God’s sake these BVI Courts need to wake up. This judgment for the horror and pain and suffering needs to be no less than $300k plus the cost of treatment for the rest of her life. Just do the math for the medication and multiply that for the rest of what would normally be her life… ie :till she makes 100 and include inflation. Plus medical bills.

    They want these dogs but wouldn’t manage them. The dogs should be put down. The owner should face criminal charges and the woman better compensated. This is just crazy.

    It’s not the dog, it’s how they are trained. Pit bulls used to be nannies cause they are so loyal and protective. A properly trained pit is an amazing family pet. A badly trained pit is a nightmare.

Why no mention of endangerment to the unborn was not mentioned in the charges !!! The well being of the baby alone should’ve been $200k+ … Wish u best of Luck Lady !!!!     Pitfalls can be very loving dogs if trained properly. Alas there are no reputable dog trainers here. I had a pit bull and he was never loose without someone at the end if his leash. They are extremely strong and will attack animals and people. Once they smell that fear you’re a target. Once that jaw locks on you it is virtually impossible to pry loose. I am surprised that lady survived the attack but thank God she did. Dog owners whether of pitbulls or any other breed need to be responsible and ensure they are contained at all times. I echo the seniments of other bloggers. That amount of money is not enough.

    Want confirmation that these dogs were put down. Sorry but unless you can secure and control your dogs, you shouldn’t have them and these dogs have proven they are not fit for society. Euthanasia please.

    Between last year and this year his dogs attack a young man and nothing was heard of the situation since, dogs can be will trained once you make the time. I’ve owned Pitbulls and Rottweilers and never had a problem…it’s the owners neglected ways is to blame.

    Do wish things had turned out better for the young lady but if he’s as scamping as his *** oh boy…..

    Can be tamed , but sometimes the wildness click in , the owner nan become a meal according to what type of animal it is / pitbulls are a mix of a jaguar or something similar , and they should be for guarding a fenced property , and should not be around children / they have been known for killing adults and children, and thats facts ( .some of the people who have them cannot even take care of themselves , so what do you expect

    Whilst I agree with your point that pits are loyal, protective breed of large dogs, I disagree that there are no reputable dog trainers on-island. My dog is a large breed and Keron is the real deal as are a few others I know of. So where and come again! Any – ANY dog with a moronic/reckless/bad owner is a danger to anyone including said owner. I agree with the general consensus that compensation based off of EC courts past judgements does not come close to being fair in this case. Nonetheless; just like reckless and irresponsible owners of cars, boats, scooters are abundant it is the sad reality in these times.

    This is the same Judge that made an order that the Esteemed pay $100k to the CoI in respect of it costs of the abortive injunction application to stop the CoI lawyers committing criminal offenses – there was not even a hearing of that application.
    I don’t know how he sleeps at night giving the criminal CoI lawyers the same as this poor woman.

    In EVERY STORY about pitbulls someone posts the obvious lie that dogs bred for fighting bulls and other dogs were miraculously also good with children. It literally makes no sense. Pitbulls bred for animal aggression and dog aggression are not the best dog for children. The best dog for families would be ones that do not have “gameness” and have more reliable temperaments.

    Lying about pitbulls just gets more kids killed.

    now this lady not only have live in pain and trauma her whole life and have an eternal fear of dogs now. I truly hope the law steps up quickly and do the right thing in this matter.

    he got apartments so he should be able to pay for it, if not the judge should take his assets that value the cost and pay her bills.
