Mervin Flaherty convicted for 3 counts of theft

Mervin Flaherty, Jr has been convicted of three counts of theft.

He was on trial for pilfering more than $400 from his girlfriend’s bank account between July and August of 2016.

In deciding the guilty verdict last Thursday, Senior Magistrate Tamia Richards said there were clear inconsistencies to Flaherty’s case and, as a result, she was “unable to believe his case on a whole.”

On the other hand, she said the witnesses that testified against the McNamara resident were believable.

Flaherty, who is unrepresented, will be sentenced on November 21.

Caught on camera

The court heard that Flaherty was caught on camera at a local bank using an ATM card belonging to his then-girlfriend to withdraw cash.

He stole $300, $100, and $20 on three different occasions.

Upon discovering that her funds were missing, the woman made a report to the bank and the police who then launched an investigation into the matter.

Flaherty was subsequently arrested and charged and during an interview, he told police: “I take it but I didn’t take all one time.”

He also identified himself as the person in the surveillance footage from the bank’s camera.

The court further heard that Flaherty was granted permission on one occasion by his girlfriend to make a cash transaction with her bank card.

It was around that time he learnt the card’s passcode and sought to make unauthorised use of it on subsequent occasions.

    Stealing from your girlfriend? How low can one get! What kind of man does that? A loser.

    I hope she dumped him like a hot potato the very first minute she found out he was helping himself to her bank account.

    So weren’t they living together and has a child. She give him the password to it. She seems to be crying foul bcuz they fallout. Take back your card, change your password and let him pay you back and move on. You are sending the father of your child to prison out of spite. Young women plz get smart you are hurting the child more than hurting the man dem cuz your child growing up knowing that you send the father to prison for couple a dollars. The more serious crimes like abuse and battery goes unreported.
