Order in Council unlikely to be triggered — Governor

Governor John Rankin has indicated that it is improbable that the United Kingdom’s Order in Council will be invoked.

This order carries the potential for constitutional suspension if the government fails to adhere to the specified timelines outlined in the Framework for the Implementation of the Recommendations of the Commission of Inquiry (COI) Report.

“My objective is that the Commission of Inquiry recommendations are addressed and the recommendations made in the Commission of Inquiry are carried out and that’s the commitment which the Government of National Unity also entered into, which I know the current government is committed to as well,” Governor Rankin said at a recent press conference.

He continued: “I hope that the triggering of the Order in Council will not be required because it’s much better for everybody if these reforms are owned by the government here and owned by ministers and owned by the people of the BVI and owned by the Governor in areas where the Governor is responsible.”

However, Governor Rankin argued that the Order in Council continues to be necessary and is an insurance policy put in place to hold the government accountable to its commitments on governance reforms.

The Governor explained that such an insurance policy is necessary, especially in the case of a significant failure to carry out the recommendations or if, for some reason, a government were opposed to carrying out those recommendations.

“The ultimate remedy is the Order in Council, which would involve, not complete suspension of the constitution — you know the courts would remain independent, the Auditor General would remain independent, [the] public service will continue to be a professional public service, but parts of the executive government would be suspended,” he explained.

The Governor said he hoped any such suspension would be for a short period and said the threat of a constitutional suspension is there “should it be needed”.

    Blah, blah, blah! I’ve turned off this reality show now and just cannot listen anymore – we’ve waited too long for a positive conclusion for this country, no matter which road was taken to get us to that point.

    But to keep hearing the Governor, the Premier, our elected representatives, and the feckless UK and their spineless bluffs just talk, and talk, with little to know substance has become very irritating!

    If any of you were in the private sector you’d be out on the very streets and the very society you neglect by now!

    Imagine some people see NOTHING wrong with a few men in the UK passing an order in council to suspend a constitution of a country (in the 21st century) unless the country functions how they say and want as dictated by their preauthored recommendations of their own prearranged COI which they have the audacity to be calling it independent which also conveniently found no fault of any Governor for the past 40 yrs. The Order in Council is a modern day slavery whip. Both the one on the Financial services & the Constitution needs to go. It is anti democratic.

    Incorrect, the UK is merely stating what it requires for the BVI to remain British, it’s as simple as that. If you don’t like or agree with their demands, independence is there merely for the asking.

    order in council is an alternative to suspension of the BVI constitution and the all the elected persons in the legislature. The extended ‘insurance policy’ could continue for decades if necessary.
