Walwyn appears in court!

Former Education Minister Myron Walwyn and the Assistant Secretary responsible for Projects during the previous National Democratic Party administration – Lorna Stephens appeared before the Magistrate’s Court this morning on charges of breach of trust by a public officer.

The two accused — whose charges are in relation to the controversial Elmore Stoutt High School Perimeter Wall Project — were granted $30,000 bail signed with one surety.

There were no bail conditions.

Walwyn, in the meantime, was represented by former Director of Prosecutions (DPP), Terrence Williams while Stephens was represented by former Senior Crown Counsel in the BVI, Valston Graham.

During the sitting before Senior Magistrate Tamia Richards, the Defence asked DPP Tiffany Scatliffe to state the particulars of the offence. The defence requested that this information include the protocols and section of the Public Finance Management Act and the Finance Management Regulations that were breached.

The defence said this information was not in the complaint laid before the Magistrate’s Court and said it is hoping that this will be disclosed in full detail as quickly as possible.

The Defence also told the court that the complaint lodged by the Prosecution did not specify the sections the DPP intended to rely upon.

The matter was adjourned till next month.

    She can’t even get a first mention in court correct never mind prosecute a matter. She can only really be effective against a litigant in person in the Magistrates Court, and even then she is not very impressive. God save us from this … Please get in a competent prosecutor to review the file and advise whether there is a case to answer (rather than waiting for the Judge to throw the matter out on a submission of no case to answer).

    Now, two observations:

    1. Here you have a prominent former member of the HOA before the court, a court that is being presided over by a female magistrate, and a case that is being prosecuted by a female DPP. Common denominator among all three: they are all black folks.

    Apart from the seriousness of the case, I think that’s a good thing in that on appearance we are capable of holding each other to account for alleged wrong doings. That’s wonderful.

    2. Now, is it me freaking out, or is it real? It appears like everybody is being arrested nowadays. Arrest for interestingly white collar alleged crimes. Something has changed. Normally it’s the poor kid on the block who gets caught with a joint or dime bags doing a hustle; now it’s the big shots.

    Feels like you don’t know who will be arrested next but you know other arrests are coming. Quite frankly, I feel like turning myself in already and let them tell me what crime I have committed. At this rate, I’m sure I did something. I just don’t know what.

    I need to do like the former speaker of the house. Go to the police station and ask them what’s the deal. Am I under arrest or not? But, I’m leaving my phone home.

    I have been deleting all my private pics on my phone just in case. Never know when the Po Po will come knocking. Don’t want those getting out God forbid.

    On a lighter note, we shall see how this and other cases plays out in time. Sit tight. But conviction? Nah…I don’t see it. Hung jury at best IMO.

    White UK officers are the ones making these ridiculous arrests and charges. They completely bypass the local officers regardless of their rank and they do what they want to do. It is the replacement of whips and chains with the justice system as a weapon. It will all come to light for those who insist on living in the darkness. It’s to demoralize us and continue to cause us to not have no trust and faith in ourselves so that we could be dependent on them for leadership. The BVI is under siege. It’s almost 100 white Uk officers here roaming around. I wonder who is paying them.

    Bad move by the defense team, I would have allowed the DPP to go along with her case and after she closes….i would have submitted a no case to answer using the said submissions pertaining to the badly drafted charges.

    If they were no contravention stated in the complaint particulars no offence to be convicted on….case dismissed

It was a blatant mis use of public funds to curry favour and if you had any integrity you would be upset about the Government’s lack of financial prudence and investment in the country with your money.     This seems to be an abuse of process to me. They hounded this man like a dog for nearly 7 years about this wall. Now you come to court, after 7 years, with all the investigators they claim came in, you cannot give what specific protocols and what specific sections of the law or the regulations were breached? This is persecution not prosecution. How could the BVI be doing things like this in a seemingly democratic society and think that this is right? The DPP should have been able by now to list that there was a beach of xyz sections of the law and it should have been placed in the complaint that came before the court.
    The UK has oversight for the BVI, how could this be allowed when they hold themselves out as the champions of democracy. How?

    The DPP doesn’t show up for murder cases which in my opinion she should always be there for those because that is the most heinous crime that a human being could commit. She send her junior officers most often. How is it now she find herself to court for these two cases plus the case with Najan Christopher? If we playing stupid let’s continue.     Shame on the DPP for lodging charges without stating the legal basis on which the charges were brought. What sections of what act were breached?? Shame on the DPP. No case to answer, through the DPP’s own admission, after all this time. Shame! This case should have been thrown out. May the good Lord’s will be done.
