10 traffic matters thrown out of court | Cases 2, 3 years old

Ten traffic-related matters were dismissed at the Magistrate’s Court on Monday, August 20.

Chief Inspector Bill Johnny said offenders who were to appear before the court either left the territory following the 2017 disasters or their addresses were not known so they could not be summoned to court.

A few other offenders who were also to be subpoenaed were never served with the relevant documents, the court heard.

Of the 10 traffic matters Magistrate Giselle Jackman-Lumy threw out of court, one was a three-year-old matter and the other nine dated back to 2016.

The offences ranged from driving without due care and attention, driving a motor vehicle when not secured by a seat belt, and use of a cellular phone without the aid of a hands-free device while driving, among other violations.

The offences were punishable by fines or imprisonment under the territory’s Road Traffic (Amendment) Act.

The offences were ‘non-ticketable’ which meant violators had to be summoned to the Magistrate’s Court to answer their charges.
