Court defers sentencing, orders men to be quarantined

Senior Magistrate Tamia Richards has deferred the sentencing of Tambu Frett and USVI resident Bryan Bolan who have both been ordered to go into quarantine for a minimum of 10 days.

The men were scheduled to be sentenced on Tuesday, April 7 after pleading guilty to the charges brought against them a day earlier.

Bolan was charged with Breach of Curfew and Illegal Entry while Frett was charged with Ilegal Entry, Smuggling and Breach of Curfew.

Magistrate Richards said prior to this morning’s sitting which was held via a Zoom call, she made contact with the relevant authorities in the Department of Health because the men needed to be quarantined before she proceeds to sentencing.

“That being the position, I have decided that I will move the sentencing to a date after the period of quarantine. So by that time, I will be fully able to know what we are dealing with regards to their status,” she stated.

She said Her Majesty’s Prison has a facility for prisoners who need to be quarantined.

Dinghy could be forfeited

Meanwhile, Acting Director of Public Prosecutions, Tiffany Scatliffe-Esprit said Frett’s dinghy is now liable to be forfeited to the government because he pleaded guilty.

“The Crown wishes to make it clear, and to state our attention in making an oral application for the vessel that Mr Frett was using on that day to be forfeited to the Crown,” she said.
