Court orders retrial after jury fails to agree on verdict for accused cops

Following roughly nine hours of deliberations, jurors in the high-profile criminal case against two interdicted police officers returned with a ‘not guilty’ verdict for one of two charges and were unable to agree on a verdict for the second charge.

Pamphil Prevost and Simon Power, who were jointly accused of conspiracy to steal and conspiracy to pervert the course of justice were read their verdicts in the High Court minutes after 8:30 pm on Tuesday, April 16.

For the charge of conspiracy to pervert the course of justice, the nine-member jury returned with a majority eight-to-one not guilty verdict. The accused cops were subsequently discharged on that matter.

Justice Rajiv Persad, however, ordered a retrial for the conspiracy to steal charge since jurors could not agree on a verdict.

The accused duo are now scheduled to return to court on April 29 at which time the Office of the Director of Public Prosecutions will determine how they wish to move forward.

Both Prevost and Power will remain on bail until then.

Initially, there were three officers charged with conspiracy to steal. However, that third interdicted cop, Shawn Henry, was acquitted after his lawyer successfully argued that there was insuficient evidence against his client.

    You know what really bother me these man suppose to up hold law. The people who put their life on the line for the game went to jail ok part of the game. some lost their life, ok part of the game you playing. But to know these fake wanna be bad man cops take man HARD WORK AND BETTER THEIR PERSONAL LIFE AND THAT OF THEIR PEOPLES SAME THING THE MAN THEM THEY ARREST WAS TRYING TO DO. Strupes put their behind right out on the streets as civilians mans will take it from there.

      A man is innocent until he is proven guilty beyond a reasonable doubt! The men may be guilty but it is the prosecution’s duty to present the evidence necessary for a conviction. Anything short of that the jury has to bring a verdict of ‘not guilty.’ It’s as simple as that.

      I have been following this case and from what I have read this case was amusing from day one. No wonder the jury finds it ‘hard.’

    That comment is totally out of order. If you have additional information that the police dont have you ought to keep your comment within reason. Everyone who is arrested are not guilty. I have no idea as to their guilt or innocence, do you. That is why we have the courts to determine whether they are in the opinion of their peers. Police put their lives on the line everyday to serve and to protect. If they are guilty they will be dealt with. If not then we owe them an apology.

    What is interesting is that the likes and dislikes button seems to be manipulated to make the negative comments be highlighted more. In any event, the jurors have to exercise the LAW and not hearsay or fabrication especially in the case of the witnesses. There is nothing to see here. Moving right along.

    The BVI is forever imperilled with the jury system. A large percentage of the community upholds and applaud criminal activity to a large degree. Family and friends are given refuge by protection/hiding them from the law with secrecy. In addition it’s inherent for the protector to remain quiet, never to speak of the illegal act even when faced with exposing an individual in court. The fact it permeates not only the Virgin Islands but also the region as a whole, there will be many guilty individuals that walk free using this juror system.
