Did prosecutors get clearance for Fahie’s security chats?

Theresa Van Vliet, the attorney for former premier Andrew Fahie, has questioned whether US prosecutors received permission to use conversations between Fahie and top security officials in the BVI at his upcoming trial.

Fahie is charged with several counts of drug smuggling, money laundering and racketeering before a Miami court and is facing possible life imprisonment if convicted on the charges brought against him by the United States government.

The attorney said some of the evidence presented for Fahie’s trial includes redacted chats with Royal Virgin Islands Police Force Commissioner, Mark Collins, and noted that despite the prosecution’s attempts at redacting some of the content, some concerns remain. Van Vliet said prosecutors want to introduce the chat into evidence to show that Fahie did not notify the Commissioner about the fact that his co-accused, Oleanvine Maynard, had introduced him to an undercover Drug Enforcement Administration (DEA) agent.

“We do not object to this exhibit, under the assumption that the [prosecution] has cleared and resolved any confidentiality or privacy concerns, if any, that the government of the Virgin Islands might have regarding this exhibit,” Van Vliet wrote in a recent pre-trial motion to the court.

Fahie’s attorney pointed out that there is also a redacted chat with the Virgin Islands National Security Council (NSC) where all but two lines are redacted. Van Vliet said the two remaining lines consist of Fahie asking for a link and saying please. She told the court that prosecutors offered both pieces of evidence simply to establish that neither the NSC nor Collins was warned about Fahie’s alleged contact with the undercover agent.

On this basis, Van Vliet said she wanted evidence from a mystery woman – identified only by the initials RS – to which the prosecution previously objected, to be introduced into the trial as well. Fahie’s trial was recently reset to begin next Monday, January 29 but may now be pushed back even further with the filing of his attorney’s latest motion.

The former premier remains confined, in the meantime, to his daughters’ home in Miami, Florida as part of his $1 million bond conditions until that time.

    The judge is going to get tired for Vliet’s BS pretty soon. Vliet is throwing s**t against the wall to see if it will stick. The BVI government or its officers have no right to confidentiality while a crime is being committed on US soil. That’s true everywhere. It’s like saying a Russian hitman has the right to cover his tracks while committing a murder in Miami. And the BVI taxpayers are paying for this legal farce.

      The Attorney is doing her job. You seem to let your personal feelings for Fahie mess with your brain cells. She is his legal representative, it’s her job to attack the prosecution’s case. Further there seems to be this narrative that once the Government charges you with something you are guilty and that Prosecutors can do no wrong. Fahie’s attorney was once a Prosecutor and one of the best so trust she knows what she is doing. If she wasn’t doing something right the case would’ve come and gone long time. The fact that there are delays every time she files motions, it says that the Judge agrees with whatever arguments she has put forward.

        Finally, someone who understands how the system works in the US! The defense and the Judge are doing their due diligence as required by law! Tax payers don’t want to have to PAY for another trial due to a hung jury or having the case thrown out on appeal bc someone didn’t do their job! Side note… Pleading guilty in the US does you NO favors when it comes to sentencing if found guilty like it does here! None at all! It bares ZERO weight! Guilty pleas are common when it comes to Plea deals n that’s it! Most people plea NOT guilty or NO contests meaning I ain’t saying one way or the other. That too carries zero weight when it comes to sentencing either.

        Thank you for articulating this succinctly.The epicaricacy demonstrated by the readersip of this publication in particular is disgraceful and exposes a clear hypocrisy. Selective application of justice; due proces for all except if there is some personal dislike or action.
