Fahie set for July trial date, court filing shows

Following closely on the heels of receiving a costlier bail offer and new conditions being attached to his pre-trial release, a July trial date has been set for former Premier of the territory, Andrew Fahie.

According to a recent court filing, the former Premier will face a jury trial on July 18 before Judge Kathleen Williams. Fahie’s co-accused, Oleanvine Maynard (the former BVI Ports Director), is also expected to face trial on the same date as well.

Court records also indicate that a zoom calendar call has been set between the parties. That call is scheduled to take place before a judge one week ahead of his trial date.

A standing order for criminal discovery has also been filed in the matter. The attorneys involved in the case are, therefore, expected to immediately reveal any newly discovered information or other material within the scope of local laws.

Revised bond

Fahie was arrested on April 28 after a months-long sting operation by the US Drug Enforcement Administration (DEA). He recently pleaded not guilty to charges of conspiring to launder money and import cocaine into the United States. If convicted, he along with Maynard and her son Kadeem, face up to life imprisonment.

Fahie’s bond was recently revised and was increased from $500,000 to $1,000,000 after prosecutors failed to get his previous bond revoked; claiming that he was a ‘severe flight risk’.

The new bond conditions come with a Nebbia hold attached. This allows the court to consider the source of funds used to post bail or purchase a bond, and look into whether or not the funds are linked to any criminal or illicit activity.

Half of the bond ($500,000) includes a previous partially secured bond (PSB) which must be cosigned by Fahie, his daughters and a friend; court records show.

The other half of the bond, a corporate security bond (CSB), requires that Fahie is to have 24/7 GPS monitoring and is disallowed from making visits to his attorney. His attorney is instead required to visit him at home. Fahie is also required to sign a waiver of extradition worldwide as part of those conditions.

The bond conditions will only be implemented once everything has been approved at a hearing before the court.

The state is being represented by Frederic Shadley while the former Premier will be represented by Theresa Van Vliet, who officially filed documents stating she was Fahie’s permanent attorney in the matter late last week.

Up to the end of last week, Oleanvine’s son Kadeem had been awaiting extradition from Puerto Rico to Miami after first being arrested in neighbouring St Thomas several weeks ago.

        BVI aint the only country to have coke conspirators and we won’t be the last. Your labeling is juvenile and unjustified. Just a lot of you haters and paid bloggers happy to focus on this because you have nothing better to do. I can enlighten you on several coke busts elsewhere since this but I think you just love the BVI too much to pay attention to anywhere else so continue to spread your love for the better.

          It is concerning that you don’t understand the moral depravity of doing business with the drug cartels, and the significance that it wasn’t just a random criminal but the head of government … unfortunately it is symptomatic of the ethical bankruptcy of the culture in the BVI. Do an honest day’s work? No thank you! If you people don’t learn, the BVI will be consigned to the back pages of history, just like Africa where thousands of children starve every day, even though the land is bountiful.

    There was a time in the distant past whereby someone accused of a crime was tried before a jury of their peers. Today, as in this case and many others before, that jury may not be from the accused country of origin but rather from a totally different country and culture.

    We have come to accept that but one has to wonder regardless of the accused crime if that process is fair to such defendants.

    Lets take a closer look. The former Premier and his co-accused are being accused of money laundering and conspiracy to import illicit drugs into the US.

    They are being judged in a country they never grew up in nor lived in for any significant period, and are being judged by people in that country and by a country that is of the view that you (the defendants) were sending drugs to our country.

    There is something inherently bias with that process and the outcome is more of a foregone conclusion.

    However, as inherently biased as it may appear, there is something called international law and treaties and extradition between countries that makes these kinds of prosecutions possible.

    The message from this is:

    The arms of the law is long. Commit a serious crime that impacts another country? Expect that you can face consequences in that other country.

    I think we all know how this trial will end for all 3 defendants. These defendants have made the case for the prosecution easily by their own words and actions. Its hard to dispute or defend that.

    Which reminds me. I need to write and say less. While I am not trying to commit no crime, I need to continue practicing keeping my mouth closed especially around people I don’t know. I should practice the same even around people I know. Cierra la boca.

    As Bob Marley once sang: Only your best friend knows your secret, so only he(she) can reveal it.

    At any rate, the trial date is quite quick given the defendants were recently arrested. Similar cases in the past took longer to get to trial.

      He was not taken from the BVI nor was he arrested here. They made sure to “catch” him on Us soil acknowledging and accepting money for the safe passage of drugs. Where else must he be tried?

      You are obviously a racist. First, you commit a crime against another country or in another country then you face trial in that country and imprisonment. I recall many, many people imprisoned in the BVI and there trials did not have jury’s of people of their country of origin. Second, in the US a defendant is allowed a speedy trial. Foy and his lawyer opted for this as he can’t get out on bond so “let’s get it over with” decision. Third, by what you have written shows you are a complete moron and just trying to cause racism in a Territory already plagued by too much of it. Back under your rock please.

      Applying your logic on jury of his peers are you suggesting that Head Coach’s trial should be held in RoadTown or perhaps in the First District? What happened with the H0dge case?

      Using your logic on his lack of connection to the US, then why should he have been granted bail?

      The timing of the trial is admirable. Head Coach, mama clown and baby clown are all on film committing a crime that took place in the BVI and The US.

      Anyone who travels widely around this planet KNOWS that in any country whenever a crime occurs in that country a foreign person is always considered guilty until proven innocent. That’s why lots of travelers only travel in their private vehicles so they can escape across the country’s borders before they can be connected to a crime. Tourists traveling on commercial planes, ships, buses are targets for criminal conspiracies everywhere they go.

    Five weeks after his arrest and still no news on other mentioned at the time. Do we assume that life is going on as normal for those people and they are still working in important roles in out Customs/ports etc?

    Why have they not been tackled? What harm are they still doing? What evidence are they destroying?

    The only difference is that the expats who feel they are being illtreated are free to leave. Fahie is, unfortunately, not free to leave the US.

    I wonder what will it be this time. Sadly the BVI have been film twice and one of those short film can be seen easily on youtube.

    First, “Murder in Paradise” this short film/documentary to me is still unsolved and I think those…. let me leave that there.

    Secondly, “Drug trafficker and Police shoot out”/Document. I think this one can be found on forensic file. But the whole document of that shoot out is given. And i think that…. Well let me leave that one there.

    And Last “Head-Coach” if they ever do decide to do a detailed document on this, which will be hard because I truly believe this will be a long going investigation. But I only mention that to shed light that right now bvi have good documentaries however the bad are taking over now.

    They are going to the big house for the big time they deserve. Many more will follow once the COI prosecutions commence.

    The sympathy you suggest should be extended towards our families who have a had to endure corruption and grotesque mismanagement for the past generation.

    Why aren’t you raising money to put the fire at our dump? Why aren’t you raising money to rebuild our schools? Why aren’t you raising money to rebuild our infrastructure?

    Were you satisfied that our hospital that we spent $100,000,000 to build sat empty for 5 years because it wasn’t designed properly? Were you satisfied when we invested $7,200,000 with a bunch a crooks who were doing the same scam (Baltia Airlines) at the same time we accelerated payments to them without even doing a Google search to see if they were legit? Were you satisfied when we spent soooo much on the pier park? Our children should not be so complacent.

    We will be a great country one day. But we shall never forget the mistakes we have made along the way.
