Fahie unaware of Maynards’ side deal, attorney says

The attorney for former Premier Andrew Fahie said he was unaware of any side deals made between his co-accused — former BVI Ports Authority Managing Director, Oleanvine Maynard, her son Kadeem Maynard — and an undercover US Drug Enforcement Administration (DEA) informant.

The former premier was nabbed in Miami in April 2022 after he allegedly conspired with the Maynards to allow large amounts of cocaine to pass through the BVI’s ports as part of a multi-million dollar deal made with the informant who was posing as a drug trafficker at the time.

Fahie’s trial was expected to commence this week after being postponed twice for Judge Kathleen Williams to hear motions put forward by the prosecution and defence. No rulings have been made public by the court concerning those motions.

A new court filing by Fahie’s attorney, Theresa Van Vliet, proposes new jury instructions for the trial and said it was part of an agreed limiting instruction over any evidence relating to the alleged side deal between the Maynards and the undercover source.

The short court filing said after hearing the prosecution’s recordings played in the court, jurors should consider that all parties agree that Fahie was ignorant of and had no involvement in those discussions or the alleged “side deal”.

“Thus, while you have heard the evidence, I instruct you that you may consider it only for the limited purpose it may have for impeachment or to put other comments on the recordings into context,” the court filing read.

Van Vliet continued: “You may not consider these discussions as evidence of Mr Fahie’s participation of the crimes alleged against him in this case.”

Maynard heads the prosecution’s list of witnesses and is expected to be sentenced on February 22, instead of the previous January 18 date that had been scheduled.

Her son, Kadeem, was sentenced last year to 57 months in prison after he made a plea agreement with prosecutors for his role in the drug conspiracy.

The former Premier remains confined to his daughters’ home in Miami, Florida as part of his $1 million bond conditions until the start of his trial.

    Sometimes side deals and under cover of darkness moves are necessary for survival and rising above the STORM. The one at the head should stay aware and never be taken by surprise (that’s how you stay salty years later). LOL

    i just read another article saying the prosecutor considers this trial “open-and-shut”. doesn’t seem to matter what the attorneys do, he is gonna be convicted. Thas cray!

    So his lawyer admits that the evidence is damning, but instructs the jury to only consider it for limited purposes. What will be her instructions after Maynard takes the stand? If he doesn’t know/wasn’t aware of any side deals between the Maynards and the undercover source, then he did his thing on his own

    What about when he took the $20,000? What about when he sent Maynard out of the meeting because he had negotiations that he didn’t want her to be a part of because of his greed?

    I hope he told his lawyers everything because they can’t mount a proper defense if the first time they’re hearing some of these things is in the court.

    Wonder if he’ll be using the entrapment defense?

    Maynard’s story may well be considered as “hear say” unless there is proof to substantiate her claims.

      Maynard’s testimony canno/ will not be considered ‘hearsay’. She’ll be right there in the witness box giving the court all the low down on Fahie’s running with her, her son and God knows who else. It’s entirely up to Fahie’s attorney to CROSS-EXAMINER her. And they have better do a damn good job of it because Andrew already said that he’s not taking the stand.

    He did the crime, he pay the time.
    We entrusted him as a maths teacher to educate our children yet he needed a calculator to determine his take of 10% of $68m a week. (My dog can do that calculation if bribed with chicken).

    We entrusted him as our Minister of Education to help our children yet look at the horrible crimes!

    We entrusted him as our Premier to lead by example and inspire our children. Fahie failed us and our children and their children need to remember his treasonous behavior motivated for his greedy personal gain.

    He has set our goal of obtaining self reliance from the UK back a generation or two.
