Fahie wants ‘expert’ cocaine witness removed

Former Premier Andrew Fahie has asked the court to dismiss a motion aiming to use the same person as both an expert and a regular witness in his upcoming drug and money laundering trial.

Fahie is charged with several counts of drug smuggling, money laundering and racketeering before a Miami court and is facing a possible life sentence if convicted on the charges brought against him by the United States government.

Fahie’s attorney, Theresa Van Vliet, told the court late last week that prosecutors advised her just before the Christmas holiday that they intended to call one of their case agents as an expert in the trial.

However, Van Vliet challenged the prosecution’s designation of Special Agent (SA) Brian Witek as an expert witness, questioning his qualifications and the basis of his expertise, particularly concerning cocaine trafficking.

“Notably, absent from the [prosecution’s] notice are any credentials, whether specialised experience, education, expertise, or specialised training, possessed by SA Witek as the foundation for whatever his expert testimony may be at trial,” Van Vliet stated in her motion to the court.

Fahie’s attorney pointed out that the notice shows that Witek has ‘no experience as an expert witness, has never authored publications in the several areas of expertise in which he is proffered, and has never been qualified as an expert by any court in the last decade’.

According to Van Vliet, the prosecution’s notice suggests that Witek will form his expert opinion based on his past work as a DEA agent dealing with international cases and the knowledge he gained from that role. Therefore, she said the defence team wants the right to question him without the jury around to check the foundation of any expert views he plans to present in court.

She further argued that the dual role of Witek as an expert and ordinary witness could be prejudicial and confusing to the jury. “Because SA Witek is also being offered as a lay witness based on his personal knowledge of the case, his testimony as a designated co-case agent will inevitably present prejudicial dangers to the defendant and heighten the risk for jury confusion. Accordingly, the notice must be stricken,” Van Vliet stated.

Fahie’s trial is scheduled to start on January 22, following several postponements due to the need to consider motions submitted by both the prosecution and defence. Fahie remains confined to his daughters’ home in Miami, Florida as part of his $1 million bond conditions until that time.

    Well…didn’t call him Head Coach because he was in sports, And pretty sure when he said It’s Not My First Rodeo, he not talking about bull riding.
    The trial hasn’t even started yet and it already getting nutty. This poor guy is in way over he head.

    Vliet is throwing s**t against the wall and trying to find something that will stick. She says guy has “no experience as an expert witness”. Next sentence she acknowledges prosecutors say he is a DEA agent with international experience. The judge is gonna get tired of her tricks. Just watch.

      do a google search, that same “Dea agent” was caught falsifying evidence to entrap a previous president of colombia before and was caught. he then fled. on that same mission he was in colombia running an illegal “investigation” without the knowledge of the colombian authorities. he better don’t get call as witness or andrew might walk one time.

        our tendency to perceive the United States and its ABC agents as beyond reproach is truly astonishing, given the clear lessons of history. It is ironic that the predominant readership of this publication is readily inclined to implicate these very agents in orchestrating the events of January 6th, allegedly at the behest of former President Donald Trump.
        Yet, when it suits their inclinations concerning someone they disapprove of, the unquestionability of the agents’ veracity suddenly becomes apparent.

        So if you were able to research and come up with that info on the man, don’t you think the prosecution already have this?

        Do you think that the prosecution will turn around and use this person as a regular witness and an Expert witness?

        AND, you do realize that Fahie’s lawyer would be in possession of this same info on the man, right.

        Believe me, Fahie’s lawyer doesn’t want this witness on the stand, but not because he’s a ‘crook’. You figure it out.

    Witnesses in criminal trials can be both an expert and an ordinary witness. They have to testify twice during the trial and are subject to cross examination of their testimony. This motion by the defense will die a quick death in chambers.
