Fahie’s bail offer on hold pending US prosecutor’s appeal

Premier Andrew was arrested in the United States last week on drug and money laundering charges.

Former Premier Andrew Fahie’s $500,000 bail offer from the United States (US) Federal Court has been put on hold.

This is because US prosecutors have filed to appeal the judge’s decision to grant the disgraced premier bail.

Fahie will remain in US custody pending the outcome of that appeal, a US court told BVI News this morning.

Judge Alicia Otazo Reyes had made the half-million-dollar bail offer in what was described as a shocking decision this past Wednesday.

BVI News understands that there is a Nebbia condition attached to the initial granting of the bond. A Nebbia condition/hearing is added when someone is charged with a federal crime and needs to post bail while the case is ongoing. During the hearing, Fahie must disclose the source funds used to acquire the assets for bail. He must convince the court that the assets were obtained with legitimate funds.

The conditions of Fahie’s now-stalled bail offer was for him to surrender his passport and travel documents, refrain from visiting any transportation establishment, remain confined to the address he provided to the court and wear an ankle monitor.

Wife also under restriction, Maynard opts to remain silent

Meanwhile, BVI News was able to independently confirm that his wife, Sheila Forbes-Fahie was permitted to travel for the funeral of Fahie’s sister later this week plus conduct some work business. However, the judge said once these duties are completed, the wife must surrender her passport and travel documents.

As for Fahie’s co-accused, Ports Authority boss Oleanvine Maynard, she is still on continued temporary pretrial detention, and has not granted any bond.

A Miami court confirmed with our news centre that Maynard has invoked her right to remain silent in the face of any questioning from US law enforcement officials. The motion was filed by her attorney, Michael Caruso who is a Federal Public Defender.

Their matter is set for arraignment and for reporting regarding counsel on May 25, 2022.

      Yes we can still pray for him. Not for him to not be held accountable for his actions but we can still pray for other things. Such as, that his life is protected even while encarcerated; that he will come to a point of repentance that he will regret his actions and asking not only God for forgiveness but apologizing to the people of the Virgin Islands ; that shame or his pride wouldn’t overwhelm him to the point of him considering … That he will gain the courage to assist with the arrest of others involved leading to the comprise and ultimate fall of this criminal organization in the BVI. Pray for strength for his family.Again that depresion and it effects won’t triumph at this time. I would like to hope if one of your family member unfortunately found themselves in a similar position that you would still want them to be safe and even that people will be willing to forgive in due course.

          If Allen Stanford got 110 years for fraud. It’s reasonable to assume that Fahie as head of state, once found guilty to the charges of illicit drugs and money laundering should get no less than 150 years.

      If Fahie escapes and makes it back to the BVI would he be extradited back to the US or would the court here dismiss the charges? Remember the Hodge case?

      Fahie was working with some bad dudes. Lebanese Hezbollah, the other “Rodeos” is playing in, and of course all of his partners in his other current “crooked” schemes (According to Maynard). Would they help him escape to save himself?

    …what a dangerous game they were allegedly getting into. People engaged in drug trafficking locally should be very mindful that the long arm of the US could snatch them up at any moment.

    The America judicial system is no place to be particularly when it comes to drug offences. The country is battling an opioid epidemic on top of other illegal drugs.

    There has been an uptick in deaths because of drug use particularly methamphetamine and fentanyl.

    In response the laws have been upgraded to punish those involved in the drug trade with some of the more severe sentences being handed down.

    Even doctors, and pharmacist are being sentenced to jail for over prescription pain meds as per the government.

    The point is: Importing or conspiring to import drugs into the US if caught has severe consequences and these three are about to face some of those severe consequences of their alleged illicit actions.

    Coming from Tortola, I don’t think the former disgraced Premier nor the former head of port and her son will find it easy being locked down in an American jail for years or a few decades.

    This has to be a shock to their consciousness. They have to filled with disbelief and regret and wish they could turn back the hands of time but there is no turning back. They have to live with the consequences of their actions.

    If convicted of these charges, they will be old people before they get out of jail. Its just a shame and a head shaker to me that they put themselves in this situation. They have essentially thrown away the rest of their lives.

    For those currently in the trade, look to this trio and those who were killed prior as reason enough to get out now. Involvement in the drug trade leads to 2 roads: 6 feet under or a 6ft cell.

    It may not happen today but each day that goes by you are heading closer to one of those 2 options. So take my unsolicited advise. Change the path you are currently on. Get out now.

        Fahies previous arrest for money laundering involved his wife being arrested too. Neither were charged. The had multiple persons taking $9000 each out of BVI and giving it to them in Miami. That is technically not illegal because the limit is $10,000.

        Where that momey came from and why they were moving it to the USA are the interesting questions.

      The VIP nor the BVI owes these traitors nothing. Their lawyers owes them their best defense. The rest of nothing.

      Now, as a human being and someone who knows what American prisons are like having briefly worked in one in a professional capacity, I do feel a little something for them giving I know these people. I used to go to church with ine if the accused when we were younger.

      Been handcuffed and chained by your feet and waist like a bad animal with slamming metal gates behind you is terrifying.

      So yeah…from my view point, I feel a bit sorry for them but my overarching feeling is that they have hurt all of us and our country by their alleged actions and now is not the time to be on some sympathy parade with them. They got lawyers.

    Do you think there is any self reflection or regret at all by Fahie? By calling himself Head of State it shows how delusional he is. By pleading Not Guilty when his hands were caught in the cookie jar! The US DEA have evidence – tapes – that he and the Maynards, on 7 April 2022 picked up the undercover DEA officer on Tortola to arrange the drug storage and payment, and his driver took him to a ‘stone’ house’ (it states he was in the passenger seat – in the car paid by BVI Government funds (probably)) where Fahie then accepted $20,OOO. Fahie then turns up at Miami aiport for the $700k cash in bags on the private plane arranged by the ‘DEA’ drug smuggler. At which time do you think he could self reflected as to whether or not these was criminal acts?

        Surely the owner of that house had to have known what was about to go down in their home. The home was described as a very nice stone house as you indicated.

        One would think that before one allow anyone to use their house for any purpose, you would ask questions and approve/disapprove? How many of us allow people to use our home for meetings in the dark of night?

        Which begs the question: Is the owner of that house comprised as well? Specifically, are they apart of illicit drug running? Were they apart of the sting?

        Seems to me, a light need to be shown on the owner of that house. Something does not appear right there. Why did they approve the use of their home for that meeting? What else do they know? Where the part of the sting? Are they into drugs themselves?

        The answer to these questions and more need to gotten. Let not race be a factor in asking or not asking those questions. Whats good for one goose is good for the gander. Conspiracies involved more than one.

      It’s quite unusual if not illegal that a person’s freedom of movement is restricted under law without some sort of charge.

      Something is going on with this, and only time will tell, but if I was a guessing person, the request to surrender travel documents is typically some form of pre-trial supervision requested by the court.

      In other words, it’s some form of monitoring of travel while under supervision.

      Supervised people are not necessarily free to go and come as they please. Surely, we will find out in due course what this is all about.

      She does not have to agree with it. Its not mandatory but rather a condition of his release. If she wants him out on bail then she would agree to the conditions.

    Inmate Fahie should stay in jail for his own protection and his family’s survival. With Fahie incarcerated for the next 20+ years and his family in the US witness protection program is the only chance for them all to get back together in 2050.

If I was the Senegalese man, or one of the cartels that these boys already working with in BVI, or the rest of his local partners, or anyone else he’d ripped off in his unscrupulous life, I would find it useful to know where AF was – ie in his daughter house in Miami.
      If I didn’t want him squeal, knowing his location would be ideal.
