Josiah’s Bay woman found guilty for using vehicle to break man’s ankle

A nine-member jury returned with a unanimous guilty verdict for a Josiah’s Bay woman who was on trial for using a vehicle to strike a man, causing him to break an ankle two years ago.

Isabella Merton now stands convicted of inflicting grievous bodily harm and reckless and negligent act.

She is scheduled to be sentenced on May 4.

What the court heard happened

The court heard that on May 20, 2018, the complainant (reported victim) was involved in an altercation with the now-convicted woman’s boyfriend.

After the tussle, the complainant was walking towards Greenland Road when a jeep belonging to Merton was seen driving at a fast pace.

Despite his attempts to avoid it, the vehicle struck him on his right side, and he fell to the ground. 

The court further heard that after hitting the complainant, Merton turned the vehicle around and was returning towards him but he lunged himself into a nearby ghut to avoid being struck again.

The court heard that Merton accosted him while still in the ghut but she was pulled away by another man.

The complaint was subsequently taken to the hospital with a malleolar fracture of the right ankle.

He spent more than a month in the hospital and had a total of four surgeries, the court heard.

Attorneys-at-law Reynela Rawlins and Nick Saunders represented Merton.

    A car is a common mode of transportation for people and goods. Before a vehicle can be legally operated, a driver/applicant must be a minimum age, mentally stable, good health ………etc and must successfully complete a written examination on rules of the road and passed a road test before being issued a license to operate a motor vehicle.

    Operating a motor vehicle is a serious responsibility, for misused and abused it can become a lethal, deadly weapon like a gun, knife, machete……….etc. The accused in this case has had her day in court with the opportunity to present any mitigating circumstances and has been found guilty by a jury of her peers and will be sentenced appropriately by a learned jurist.

    The BVI is a civilized democratic society that has the rule of law as its twin. Justice must be blind and administered fairly and equitably regardless of gender. Let lady justice reign. Driving is a privilege, not a right, and whatever sentence is handed down this accuse should have her license suspended for a lengthy period, under go some mandated counseling and perform at least 100 hours of community service on the proper use of a motor vehicle.
