Judge upholds Fahie’s guilty verdict after 2 jurors seek to back out

A Miami judge has upheld the guilty verdicts handed down by a 12-member jury during the drug and money laundering trial of former Premier Andrew a month ago.

US District Judge Kathleen Williams made that decision on Thursday after subpoenaing two jurors who sought to recant on the verdicts they and 10 others unanimously decided on for Fahie.

However, only one of the two jurors appeared before her. Among other things, Judge Williams asked the one juror whether her guilty verdicts at the end of Fahie’s trial were actually her decision.

The female juror responded, “Yes,” prompting Judge Williams to allow the guilty verdicts to stand. The judge also said she would not make any further effort to bring the other subpoenaed juror into her courtroom for questioning, as she described him as “elusive”.

Fahie is scheduled for sentencing on April 29 — just one day past the date he was first arrested two years ago at a Miami airport by US Federal officials. He faces a mandatory minimum sentence of 10 years up to life on the cocaine-import conspiracy conviction.

Guilty as charged! I have such disdain for this man and what he did and tried to do to the BVI. For those of you shouting “free the drew”, have y’all forgotten who he THOUGHT he was letting in to the BVI for a few million coins? SINAOLA CARTEL. How many young men have to diE,go missing or end up in prison to satisfy your petty greed? Wake up BVI. It ot worth it and the DREW WILL NOT FREED TODAY OR ANY DAY SOON.

    Interesting.
Both jurors were subpoenaed to court.
    Ok.
One does not show up to a court ordered subpeonaed.
    Ok.
Isn’t it convenient for the defense that one did not show and the other one answered yes without showing why they went against their unanimous decision.
    Hmm.
Type in “consequences of ignoring a subpoenaed” in google and you’ll get –
The legal system takes the issuance of subpoenas seriously, and failing to comply can result in severe consequences. Individuals who disregard a subpoena may find themselves facing charges of contempt of court, along with potential fines or even imprisonment.
This alone could warrant a mistrial or at least a continuance until the said individual is found(bench warrant)
So what legal sense it make to not say she not goin make any effort to reach him because he “elusive”
Everything about this case fishy…some powerful people pulling strings. Boy Drew, you shoulda never made enemies with that sketchy looking “Gus”. The people vindictive bad, and don’t play to flex their authority to put you “in place”.he probably sipping on some expensive cognac with his feds and Lebanese friends.

@Fishy Fishy, the only thing ‘Fishy’ here is the possible ‘Jury Tampering’ which the Judge has put to the test and satisfied herself in the absence of the Juror who was not the main concern, as opposed to the one who did appear. Bottom line is all 12 returned a guilty verdict and were dismissed then the nonsense started. Judge is sound on this one, and Head Coach is going to be missing from his team for some time now! Goodbye and Goodnight Mr Fahie.

The obeh man needed to do some homework on Florida/ US law. Pay the juror to say innocent before being dismissed as a juror. What going yo happen to Fahie pension now? What slithering snake will say still give it to him?

  5. Not surprised. (Take your time reading. A bit lengthy) says:

At the onset of this saga, I predicted Head Coach was going to be convicted, and he was. This snafu with these 2 jurors will assuredly give wings to his expectant appeal.

Now, I will like to play the devils advocate for a minute here.

    To the BVI Christian Counsel:

Where have you been in this entire saga? What is your position on this case?

You seem to have only energy for gay marriage. What about the conviction of the former Premier?

Do you support what he was convicted of? What about the drugs flowing in and out of our country? Any thoughts about that?

Have you forgiven the former Premier? Have you prayed for him? Have any of you visited him in jail?

Please opine. Your silence is deafening.

Since we are supposedly a “Christian nation”, the least I would think you could do is cover Head Coach in prayers or visit him in jail…right?

Anyway, with his conviction now being affirmed, I expect that he will get anywhere from 10 to 25 years.

I have said before that I did not see him getting life, and if he does it will come down to him being made an example of as a political case.

There is a reason I am saying this:

This is his first conviction(offense) as serious as the charges he was convicted of are. He was not convicted of killing anyone, so that will be part of the decision when it comes to sentencing.

Additionally, there were other Caribbean leaders who found themselves in a similar situation but never got life.

Even Manuel Noriega, the former President of Panama who faced a little more charges than Head Coach didn’t get life.

He got 40 years in the US and ended up serving 11 years after getting a reduction for good behavior.

He was subsequently extradited to France who sentenced him to 7 more but extradited him back to Panama to serve out his sentence after one year there when he was diagnosed with a brain tumor.

The point is: He will get most likely significant time but not life. One day he will be back in the BVI a much older man so long as nothing happens to him in prison.

I have had my say multiple times relative to Head Coach, but I want to turn my attention now to all the hypocrites who supported him, and are now silent as lambs.

He had one good friend who got him out of jail under house arrest prior to the case, but what about the rest of you who benefitted from him in some way? Why are you silent now?

I know why. You are all a bunch of hypocrites. Smile in peoples faces, share the loot, and when blank hits the fan, you are no where to be found.

Please do not get me wrong. I do not support Head Coach activities in any way.

What he did is terrible and he needed to face the music as he is facing now, but I just want to call out all the hypocrites who were in his corner so long as he was doing things for them who have gone silent.

There is no way Head Coach could have been involved with drug running’s for so long and no one around him had no clue.

That includes others members of government who I believe heard or knew something was up with him and decided to play deaf and blind all the while praying with him in the streets.

Come out the closet for God’s sake so that the world can see your hypocritical faces. You are no better than Head Coach imo. Some of you deserve a jail cell right next to him.

Some of you best make certain you have your house in order before you catch the next ferry to St. Thomas. I would imagine the U.S. is on high alert and cant wait to get their hands on you hypocrites.

The US had their eyes on Head Coach for decades; they will do the same to you if your hands are not clean.

I would not be surprised if one day I hear one of you hypocrites getting dragged into this net. I would not be surprised at all.

If Head Coach had any once of sense left, he would have ratted out every last one of you who engaged with him, copped a plea, and save himself a very long prison sentence, but when you are a narcissist it’s impossible to see your wrongs and short comings until it’s too late.

So get back to us BVI Christian Counsel. I look forward to your very vocal response.

    Kind Regards,

    Your antagonist.

The two jurors have open up an investigationinto thier lives, don’t be suprise if you hear fahie get a lil extra for jury tampering

That is EXACTLy why mr. didnt show up. Its one thing to say you didnt mean to vote yes. Its another thing to say that under oath.

      • Smack Dabb says:

They can alway go talk with the obeh man and see what he could do. At a discount, he might pull a devils advocate style swallow you tongue type job on the prosecutors. It don’t work the last time but twice might be the charm

My sentiments exactly. I agree with the consequences being administered, but moreover I hope it leads to actual transformation and I hope others that are involved in similar works will take their cue from this case, to turn from their wicked ways.

The simple fact that he was willing to get involve with such a notorious cartel speaks volume for his integrity. I am sure he has internet and fid not back out of the deal because of the greed and the power the money could bring.
