Man charged for Sunday’s murder not the shooter, court hears

Hasani Frett, the man charged in connection to Sunday morning’s killing of a man in Road Town, was not the shooter in the fatal incident.

This is according to allegations outlined in the Magistrate’s Court where Frett appeared today (Wednesday, February 15) on charges of murder, inflicting grievous bodily harm, and possession of a firearm with intent to endanger life.

According to the Director of Public Prosecutions, Tiffany Scatliffe-Esprit, Frett and an associate had just left a nightclub in Road Town and boarded their vehicle just before daybreak on Sunday, February 12.

Reports are that they were parked in the vicinity of multiple surveillance cameras. It is alleged that while the two men were seated in their vehicle, three masked bikers rode up and surrounded the car.

The court heard that Frett’s associate, who was in the passenger’s seat of the vehicle, pulled a gun and fired shots at the bikers — fatally wounding one. The other two bikers as well as the shooter fled thereafter but reports are that an unsuspecting woman was also shot in the leg.

The court was also told that when police arrived at the scene, the deceased gunshot victim was found masked with two loaded guns in his possession.

His identity is still unknown to the police, the court heard.

Back in court, where Magistrate Kadeen Palmer presided, a bail application was not made for Frett nor was he made to answer to the charges as the offences for which he is charged are indictable and can only be heard before a High Court.

He was therefore ordered remanded until his next court date on March 30 when a process will begin to commit his matter to the High Court.

Frett was represented by defence attorney E Leroy Jones.

    A bail application could have been laid before the magistrates court before they send the matter up to the high court. Based on what he is saying, he is pleading not guilty. He is saying he did not commit any crime. He was just a passenger in a car. Anyhow, seeing it was an attempt on his life and self defense based on how they found the victim with mask and TWO GUNS, it sounds like he might be safer out of public view for now, until the others are found and until the deceased is identified.

    The DPP appears at this sort of hearing – where it is just a matter of setting out the accusations and not even a bail application to oppose. As soon as the matter gets contested she will drop out and hand it over to one of her junior, but more competent, lawyers.

    If the associate’s identity is known and he was the shooter why hasn’t he been brought forward and charged if it is understood, based on the surveillance footage that Frett was in the driver’s seat and did not commit the crime he was accused of.

    Hasani if you are withholding the name of the friend you were with I strongly advise that you just say who they are because I can guarantee you if the roles were reversed they would tell on you. This is your life and freedom you are playing with. Do not be loyal to a fault.

    The Defendant will say that he did not fire the gun, and that his unnamed associate did it without any encouragement – as the CCT will confirm. The DPP will lose the case – although she will be careful not to prosecute it herself – and will (and should) stick to undefended matters in the Mags court.

    You don’t need to be holding the gun to be judged guilty of a crime. For example, you and a buddy decide to rob a shop. He holds the gun; you drive the getaway car. You’re both guilty of armed robbery. So not shooting the gun doesn’t get you off.

    The self-defense claim is interesting. It seems like there was a lot going on Sunday at 4 am! Doubt any of these guys were preparing for early Mass.

    Well I must be Crazy. Mr. Crazy that is. What about the two other scooter riders that initiated the attempted armed robbery. They are the ones that are to be sought and charged for murder! Not someone who witnessed his associate defend himself. What kind of crazy laws are in place that would allow Mr. Frett to be charged for murder knowing the circumstances. Hanging life in prison over him is madness. Now it’s too much work for the officers/detectives/DPP to find the other scooter assailants so they charge an innocent man. Maybe trying to get him so you charge him. But he won’t talk because he understands what they went through and will have principle. Something the DPP and crew lack with help of the sick system. Just do your job and find and charge the other assailants. Mr. Frett is to be home with his family, Thanking Jehovah for allowing him to be alive today despite the assailants’ devious robbery plan.

    Agreed re your layman explanation of Joint Enterprise. But a joint enterprise seems a far stretch in this case. You will notice in your example the parties had agreed/colluded and were in the process of the illegal activity of robbing a bank. In this case, what would have been the illegal act Mr Frett and his associate colluded to do? How does the DPP prove Mr Frett was aware his associate was in possession of the gun? As a matter of fact how do you also prove possesion on the part of Frett? For all we know the gun was on the associates person the hold time and not stashed anywhere in the vehicle. There is a lot for the DPP to establish here in order to prove Joint Enterprise.

    My point exactly. Why is Mr. Frett being charged with murder when he clearly didn’t pull the trigger. If Mr. Frett and his associate were about to be the victims of armed robbery or even murder they have the right to protect themseleves for everyone see the Police are not helping protect individuals. Mr. Frett did not had any intention to commit any crime, he was the victim. The associate happened to be prepared to defend and got the upper hand. To charge someone with murder there should be an intention to do so and the video clearly shows who were the ones that had the intention to commit a crime. The two other scooter riders are to be the ones charged with murder, not Mr. Frett or his associate. The charge for the associate should be involuntary manslaughter and a charge for the gun and maybe an accessory to involuntary manslaughter or a penalty or suspended sentence for without holding information for Mr. Frett. The BVI is not a real place too much wrong is going on. The Police don’t even patrol the streets anymore, especially at night.

    Was the female on the scooter?
    Did the scooter rider first head to the hospital?
    Did it head East, West, where…check.

    Could also be a retaliation though not saying the accused had anything to do with the other murder.

    If a person is charged with a crime due to their association with someone else, but prosecutors do not have sufficient evidence to prove they actually committed a crime, then that person should be found not guilty. This is not always the case, and anyone charged with a crime faces an uphill battle. A skilled criminal defense attorney will be able to punch holes in a prosecution pursues charges made based on a person’s association with someone else.

    This applies where premeditation is proven. In this case it seemed like a spur of the moment issue where the passenger pumped some shots into the masked gunman after they were pounced on. How can the driver be held liable for a situation that unfolded unexpectedly?

    The scary part about this is no one is talking about capturing the other two masked bandits who may be from god knows where Haiti or Timbuktu.

    That’s how this place could go down the drain especially if they think they can get away with it over & over. At that part I am glad they were able to excersise self denfense. If this keeps up we will need to legalize guns.

    This is what happens when we go from traditional UK common law to American style law.

    We all know what is right or wrong yet the law will say some stupidity that doesnt align with what is common sense.

    Self defense against a MASKED GUN WEILDING BANDIT should always be justified except in the face of exceptional evidence to the contrary.

    There is UK common law, American style law and we are struggling to arrive at Caribbean/Virgin Islands style common sense law.

    As far as who to blame. Who is in charge of border security and policing????

    Why do these bandits feel emboldened in the middle of town at the cinema where we all have been to at some point in time.

    It’s possible these guys just like being around the HOA at 4 am on a Sunday – imagining their future in politics or something. It’s also possible there was an antecedent event like a drug deal gone wrong, a shooting – who knows? We need all the facts, and we don’t yet have them.

    This was not a planned thing hassani or his asscociate did not plan to shoot anyone.

    The associate just defended himself and hassani. At no point in time did the story say hassani held a weapon or fired one.
