Reckless driver who caused man to lose leg to spend 45 days in prison, ordered to pay $80K

Not the accident mentioned in the story.

A Virgin Gorda resident was ordered to pay $80,000 in compensation and will serve 45 days at Her Majesty’s Prison since his reckless driving caused a man to lose a limb three years ago.

Andrew David was initially sentenced to 90 days. But, considering the time that has already passed since the offence, Senior Magistrate Tamia Richards ruled for the offender to only serve half that time.

During his court appearance on Tuesday, the senior magistrate said the remaining 45 days will be suspended for one year. That effectively means the offender will only serve the next half of his 90-day sentence if he commits another offence within the next year.

What the court heard happened

The court heard that on May 21, 2016, the victim, Cliff Creque, was socialising with friends near an apartment complex on Virgin Gorda.

Creque was said to be standing roughly two feet away from the sidewalk when two motorcyclists passed heading in an easterly direction.

During that moment, a jeep travelling in what was described as a high speed, swerved close to the sidewalk and struck Creque.

Upon impact, Creque was tossed in the middle of the road, causing his trousers to become ripped and his legs to bleed profusely.

He was subsequently taken to the Nurse Iris O’Neal Clinic on Virgin Gorga and later transported to Peebles Hospital — now called the Dr D Orlando Smith Hospital.

The victim underwent surgery there but was later flown to Colombia where he received further treatment. Because of the seriousness of the injuries, one of his legs had to be amputated.

On May 22, 2016, the court heard that the officers were made aware of the accident, and they launched an investigation.

The offender, David, identified himself as the driver of the said vehicle and was subsequently cautioned, interviewed, and charged with the offence of reckless driving.

    As far as I am concern, $ 80,000 is not enough compensation to cover the victim pain and suffering. He should have been made to pay the victim at least $ 250,000.

      I think 1 million USD is the appropriate amount that criminal should have been made to pay for a life time of suffering!

      He also should have been made to pay medical fees for the next twenty years!

      80,000 USD IS A SLAP ON THE WRIST GIVEN THE LOSS OF INCOME AND LIFETIME ADJUSTMENTS THIS YOUNG MAN MUST FACE!

      Please grow some common sense.He hit the man and he is and should be held liable. If someone trip on a loose piece of concret or a loose brick in in my front yard and end up getting hurt or breaking a arm or leg I can be held liable or possibly sued.

      Just a quick question, forbid not, If you walk into a supermarket and the door for some reason closed on your hand causing you to loose your hand,you would expect the owner to come up with the money one way or another.

    No mention was made in regards to his auto insurance, if he had auto insurance it should cover
    up to a certain amount for medical and the personal injury part of his policy would cover for the pain, suffering etc, all of this would be based on the amount coverage that he carried.

      Dude lost a leg. What can the insurance possibly do to make that right. Not to mention If he was found guilty of a crime most insurance lapses and doesn’t cover you. Always experts in the BVI but without expertise or even experience smh

        @CW: Yes he lost a leg and insurance cannot make that right, however insurance can COMPENSATATE him for the lost of his leg, pain, suffering, lost of income etc. Get off your high horse and stop acting like a fool. For you information I have over 30 years of experience in Property and Casualty insurance.

          You give up your leg for 80k and tell me if you feel compensated. That’s the point. It isn’t enough.

          Take your 30 years of screwing customers (that’s what insurance people do) and tell me how proud you are of the people you helped. Oh right. You offered people pennies when they needed dollars. Don’t pretend that 30 years experience makes you anything but an employee.

      I hope some good comes out of it and I hope he was covered at the time of the accident. That is why as a parent,I always stress to my daughter the importance of having driver’s insurance.

    At the end it was an accident have a heart it has a lot of reckless drivers at some point in our driving ability no amount of money can make a person truly happy, 80,000 may not sounds enough for allot of u but where is this young man gonna find 80,000 dollars in this yah time

    Allot of you does be driving recklessly everyday on that high way changing lanes to get pass by in top speed what if one day you check ur mirrors u see your judgment u make your turn to change lanes and here comes Mr Scooter Rider who has taken down all the traffic and now about to pass you then suddenly as u sway u hit him off his bike cuz him to loose his life no let’s stick with a leg how would u feel who would u blame are u willing to pay 80,000 or more to easily if your find at fault?
