Rosan wants COI into Bank of Asia, Delta Capital investments
Outspoken media owner and political hopeful Rosemary ‘Cindy’ Rosan has called on Governor Daniel Pruce to establish an independent Commission of Inquiry (COI) into the government’s controversial Bank of Asia deposit, its investment in Delta Capital and the wider management of public funds, arguing that only an external investigation can restore public confidence.
In an open letter addressed to the Governor, Rosan said the territory had already experienced one Commission of Inquiry that exposed “deep and systemic failures” in governance and financial management. Still, she contended that fresh concerns surrounding the handling of public money now warranted another independent examination.
“Today, I respectfully but firmly call upon you, in your capacity as Governor of the Virgin Islands, to exercise your constitutional responsibilities and initiate an independent Commission of Inquiry into the Bank of Asia matter, the government’s investment in Delta Capital, and the wider management of public funds,” Rosan wrote.
Rosan, an independent At-Large candidate for the next general elections, argued that unanswered questions remained over both investments despite public statements from government officials.
“The explanations provided thus far have only deepened public unease,” Rosan stated. “Questions surrounding the placement of Government funds with Bank of Asia remain unresolved. Questions surrounding the Government’s investment in Delta Capital continue to attract public concern.”
Rosan referred to statements indicating that former Accountant General Arnold Ainsley authorised the placement of government funds in Bank of Asia and that Premier and Minister of Finance Dr Natalio Wheatley said he was unaware of how the transactions occurred. She also noted that limited public explanations had come from Financial Secretary Jeremiah Frett and that questions had been raised about the role of former Deputy Premier Lorna Smith. However, she argued that responsibility could not rest with a single public officer because public funds pass through established systems of governance, oversight and financial controls.
She proposed that a Commission of Inquiry examine the Bank of Asia deposit, the Delta Capital investment, the roles of relevant public officials, compliance with financial regulations, the adequacy of government risk management systems, whether warnings or professional advice were overlooked, whether anyone benefited from the decisions and whether the two matters shared common decision-makers or governance failures.
Rosan stressed that she was not alleging criminal conduct.
“I am not asking you to presume guilt,” she wrote. “I am asking you to ensure that the truth is established through an independent process that commands the confidence of the people.”
The call follows months of scrutiny over the government’s US$5 million deposit in the now-defunct Bank of Asia and, more recently, disclosure that a separate US$2.5 million government investment in Delta Capital was made without the approvals required under the Public Finance Management Act.
Premier Wheatley has said the Delta Capital matter is under investigation by the Financial Investigation Agency and that a new investment policy has since been adopted to strengthen oversight of public funds.

So what was the level(s) of involvement of the Financial Secretary (FS) and the (2) Deputy Financial Secretaries (DFS’s) on these matters? Anyone in the MOF that saw the requests for these transactions and who all were signatories of the transfer of funds?
Why hasn’t the reports/audits been made publicly available?
Did FSC know about these transfers? What is FIA’s position on these matters? Everyone seems mum and the Premier is seen holding the bag with not much information that he can or is willing to share. More questions than answers!
