Trio accused of killing Trumayne ‘Passion’ Daway freed
The three persons accused in the Trumayne ‘Passion’ Daway murder trial were freed today in the High Court.
Vernon Bernard, Maybelline Rodriguez and Rafael Harrigan were charged with murder and illegal possession of a firearm.
But Justice Richard Floyd upheld a no-case submission submitted by the defence attorneys representing the trio. The judge, thereafter, indicated to the jury to return a not guilty verdict on the two charges.
Justice Floyd indicated he considered the evidence presented by the prosecution before the court and it was not strong enough to proceed with a case against the three accused.
Deputy Director of Public Prosecution and principal prosecutor on the case Kellei-Gaye Smith said the Crown will consider appealing the decision.
Harrigan was represented by Michael Lashley QC and Michael Maduro, Bernard was represented by Richard Rowe, and Rodriguez was represented by Valerie Stephens-Gordon QC.

the prosecution was very weak. from the police to the deputy director. look at how an inspector of police give evidence. wow.he was far from prepared. I would say one last thing here now.all the promotion that these police are getting is laughable. most of them are I’ll prepared to deal with matters like this in a court of law.on Facebook yes they are specialist in every field but put them with a few good lawyers and they shake like bamboo leaf.the police are the ones that do the ground work and if it is not done properly the prosecutor would have a weak case.so do not blame the prosecution alone.
Not because the cops didn’t do things the right way means they are inno_ _ _ t. Those of you with common sense can put 2 and 2 together. This is just sad and I hope other families of victims are not discouraged about the justice system….cause the justice system can fail, but KARMA wouldn’t

It starts with the Police force. The DDP can’t successfully prosecute a case with evidence these Incompetent police provide unfortunately.
The DPP decides whether or not to prosecute based on the evidence the police provides. The DPP is at fault too.
I disagree. The DPP is in a position to guide the police in the way forward. Not just to look like prosecutors in their black robes. That’s only part of it. They are woefully ill prepared to handle real cases but can easily destroy the family lives of honest people who made mistakes along the way. Their specialty is selective prosecution, now the prayers of all those who they destroyed along with their families are bearing fruit. The files go to the DPP’s Office for instructions just like they send the files of minor matters to destroy officers that could have been advised another way. Well We are in mucho problemo with that set. This is the definition of INCOPETENCE! Lack of humility on the part of the DPP and pride. Nuff said. By the way, this does not mean that the trio was not involved. It was only that they could not convince the court enough. Many guilty accused go free because the playing field was not level.

They can’t sue the Government. The police had reasonable cause to believe they did it. That is all that is required for the police to hold them.

Police is very week. From the start. There were two officers that were exceptional but all the rest needs to go home.
Prosecution wasn’t no better. Can’t build a case to save their soul. What a waste.

How can a judge tell the jury to rule Not Guilty?. Of course they will find that wsy if instructed by a judge to do so. Why not let them vote THEN decide if a no case. Let the vote be honest.

When u have a set of police that never worked and ubput them in position because of favouritism thats the type of result u get. To many police i. Specialist post that dont even know how totake or give a proper statement. The police force needs to be looked at and theright persons needs to be put in the right places. The crown will continue to loose its cases.
