Walwyn unfazed by DPP’s appeal of Breach of Trust case
Sixth District Representative Myron Walwyn says he is not concerned about the Director of Public Prosecutions’ (DPP) decision to appeal the recent dismissal of his breach of trust case.
During a recent discussion involving members of the Progressive Virgin Islands Movement (PVIM) and the National Democratic Party (NDP), Walwyn was questioned about the DPP’s decision to appeal the ruling.
“My position was that we are innocent of the charges brought against us,” he stated.
“Our no-case submission was based on the fact that there was no evidence, and there was no evidence because there was no wrongdoing,” he continued.
Walwyn expressed confidence in the judicial system and said he believes he will be vindicated again.
“And the Chief Magistrate, in her very good ruling, ruled that there was absolutely no evidence that any wrongdoing was committed at all,” he said.
“The DPP chooses to use her authority to do the appeal process, that’s a battle for her,” he added.
“The Court of Appeal will make a determination at that time. I have the utmost respect for the judicial system of the BVI, and I trust that the Appeal Court will do the right thing. So I am not worried about it because I know we did absolutely nothing wrong.”
Walwyn was charged in 2022 in connection with the controversial Elmore Stoutt High School (ESHS) perimeter wall project, which reportedly saw significant cost overruns during his tenure as Education Minister.
Senior Magistrate Tamia Richards ruled on January 25 that Walwyn had no case to answer and acquitted him of the charge. Former public officer Lorna Stevens, who was also implicated, was similarly acquitted.
Despite the ruling, the DPP has moved to appeal the case, extending what has been a closely watched legal battle.

The DPP needs to be fired. She is arrogant, incompetent and she is wasting government resources on stupid cases that have no evidence. She needs to spend her time helping the police to collect the right evidence to prosecute the many unsolved murders that we have in the BVI. Instead she is here on what clearly is a witch hunt against Myron. If you can’t even get pass a preliminary inquiry how you expect to get pass the court of appeal?
That DPP NEEDS TO BE REPLACED. The only thing she does is sit back and collect a big paycheck and continue the WITCH HUNT AGAINST MYRON. You can take a woman out the bushes but you can’t take the bushes out the woman. Bush woman mentality central in the BVI.
This does seem to be q bad decision. They need to focus on prosecuting cases that have substance to them. A waste if their limites resources and means they will keep failing when it matters. There would seem to be some political pressure being applied as in the old days when the VI was run by a convicted criminal.
In how incompetent the prosecution service is, allowing him and everyone else to do as they please .

Senior Magistrate Tamia Richards determined that Walwyn had no case to answer and acquitted him of the charge.
That being the case, I would think that the DPP in their appeal of the Senior Magistrates’ ruling will either have to:
1. Prove the Senior Magistrate erred in her ruling, and
2. Come up with some new evidence, and
3. Convince the Court of Appeal that this new evidence warrants a new trial. Note I said new trial as the old one is DEAD.
I’m not holding my breath on a positive outcome for the DPP given their history of failures on important cases.
If the appeals court sides with the defendant, it would mean there are two rotten eggs on the face of the DPP, and that would not be pretty.
I don’t know how many cases the Senior Magistrate has had overturned by the Appeals Court, but if her verdict is reversed on appeal, then that would not be good either.
I think it’s rare for Appeals Courts to reverse a trial judge who made a decision after he/she has looked at the evidence before them unless there was some serious error.
Finally, there is this matter of double jeopardy that may end this matter once and for all. I am unsure if it applies in these U.K. territories whereby the law prevents the same person from being tried twice for the same offense. If it does, case close.
So in my view, I am going to go out on a limb and suggest that this case may not go the way of the DPP. If by chance the DPP wins on appeal and a new case is filed against the defendant, I do not foresee a unanimous rendering of guilt by a jury against the defendant.
Either way, this is the justice system in motion. Whatever the outcome, it will be what it will be.

Here we had Senior Magistrate Tamia Richards going up against, legal eagle Terrence Williams. I personally didn’t anticipate a different outcome. So let’s wait for the Appeals court decision.
