Fahie denies ringleader role in drug conspiracy

Disgraced former Premier, Andrew Fahie

Former Premier Andrew Fahie has denied playing a leading role in the drug conspiracy for which he was convicted earlier this year.

Fahie was found guilty in February 2024 on charges of conspiracy to import cocaine, money laundering, and foreign travel in aid of racketeering.

In a filing earlier this week in the Southern District of Florida, Fahie’s legal team responded to the prosecution’s objections to the Pre-sentence Investigation Report, which suggested enhancements in his sentencing based on Fahie’s alleged role as a leader in his criminal activities.

The prosecution contended that Fahie was “an organiser or leader of a criminal activity that involved five or more participants or was otherwise extensive.”

However, Fahie’s lawyers argued that the evidence presented during the trial does not support the prosecution’s claim. They maintain that Fahie was not the driving force behind the conspiracy, emphasising that the lead roles were played by undercover agents and informants controlled by the U.S. government. The scheme, they claim, was orchestrated and manipulated to trap Fahie.

Inconsistencies

The response highlighted several key points to counter the prosecution’s stance. It pointed out inconsistencies in the prosecution’s characterisation of Fahie’s involvement and authority within the conspiracy. For instance, during the trial, the prosecution’s own evidence suggested that Fahie’s actions were primarily directed or influenced by other participants, such as Oleanvine Maynard and Roxanne Sylvester, who were allegedly deeply involved in the planning and execution phases of the operations.

Fahie’s team also refuted the claim that he exercised decision-making authority over the criminal operations. They argued that the meetings and decisions were significantly steered by others within the conspiracy, particularly the confidential source (CS) who was central to the prosecution’s case. The filing also clarified that Fahie’s role in the alleged conspiracy was not as an organiser but was misconstrued and overstated by the prosecution.

The response dismissed the notion that Fahie was responsible for recruiting other participants, including claims that he directed high-ranking Customs officials. They described these allegations as lacking substantive evidence and context, pointing out that much of the U.S. government’s narrative was built around out-of-context snippets from intercepted communications.

The legal document also countered additional sentencing enhancements related to Fahie’s alleged abuse of trust and leadership in the conspiracy. His attorneys argued that these enhancements constitute ‘double counting’, which they claimed are based on the same aspects of his conduct.

      I am no friend of Fahie but on this point he may be right. He didn’t go looking for the agents. I suspect if it had rots in hell but if it had gone ahead he would have been paid rather than pay others. That’s not a ringleader.

    These are just tactics by a desperate Defence hoping for a lesser sentence. The reality is that Albert is going to be behind bars for a long time and that’s down to his own greed and stupidity. Personally I think he should get an increased sentence for the deceit and fraud committed as the leader of the BVI to his own people!

      I believe you are referring to Noriega in your post. Correct me if I am wrong but from the look of it Mr Fahie will most likely get 20 to 35 years. He was found guilty on all 4 counts with 1 count carrying a maximum life sentence.

      This man, Mr Fahie is fighting for his life! It’s just so sad how we sometimes allow greed, so called friends influence us to do evil. May God have mercy on Mr Fahie. We all deserve grace!

    Before opening this article I was wondering if he had gotten his sentencing date changed again. Now I know he’s objecting to the prosecution’s argument for more jail time.

    We still have to wait and see what the sentencing judge will do on August 5th.

    Fahie should win this one. He really was not the ringleader. He was entrapped by the ringleader after being recruited by the Maynards. He didn’t say no to either of them and did not report them to authorities. But he was not the ringleader of the conspiracy.

The US is a dirty set of demons but their end is imminent. What was done to the O’neal and Christopher women shows the nature of the beast but locals glory in the fall of their own.`

    Player, Ringleader or Bystander, you’re still complicit. The fact he was the “top” of the public service and knew the roles of the 3 players makes him all the more the head of the orginisation. All Fahie would have to do is to say “NO” and lead, but instead he chose to say yes which automatically had him as all powerful to open/close borders, rig Customs through known players. All I hear with Fahie’s recent legal wrangling is fear – fear of imprisonment, what can happen there and about the loss of privacy and freedom to do what’s beyond the walls of a 1 bedroom Florida apartment.

    Fahie deserves whatever punishment he gets for breaching the trust of everybody that put faith in him when they elected him and his party however the narrative that Fahie was a ringleader in this is false. Fahie was a pawn and wasn’t even the main target. They tried to get Maynard but Maynard contacted Fahie because she needed help in the scheme.
