Kadeem Maynard wants reduced sentence for guilty plea

Kadeem Stephan Maynard, one of three persons fingered in a drug and money laundering scheme which allegedly included former premier Andrew Fahie, has requested a reduction in his sentencing range as offered by prosecutors in a plea bargain.

Documents filed in initial court proceedings suggested that it was Kadeem who brought the scheme to his mother, Oleanvine Pickering Maynard, who in turn allegedly pitched it to the now-disgraced former premier.

That scheme would have allowed the BVI’s waters to be used in helping to moving thousands of kilograms of cocaine from Colombia through Tortola to Puerto Rico with a destination of Miami and later New York.

Kadeem agreed back in June, along with his mother, to accept a plea agreement with US prosecutors, which saw him pleading guilty to a single charge related to a conspiracy to import cocaine.

In exchange for substantial cooperation, That agreement offered the possibility of avoiding a life sentence in prison for charges related to a drug and money laundering conspiracy in the United States.

Prosecutors previously filed sealed pre-sentence investigation reports for the Maynards in late July and lodged amendments late last week.

Kadeem’s attorney, José Rodriguez, filed a motion on August 7 requesting the reduction, based on the amendments introduced by the US Sentencing Commission and the specific criteria outlined in §4C1.1. – which are only scheduled to take effect on November 1.

Maynard asserts that he fulfils all the criteria outlined in the new guidelines, which include, among other things, a lack of criminal history points, the absence of violence or credible threats, no death or serious bodily injury resulting from the offence, and non-involvement in certain specific offences.

One of the amendments suggests that a sentence other than imprisonment may be appropriate for individuals eligible under the new guidelines and advises that a departure from the guideline range could be suitable if the gravity of the offence is overstated.

Prosecutors had earlier proposed both Maynards serve a mandatory minimum term of imprisonment of 10 years unless the judge determines they are ‘safety valve eligible’. A “safety valve” is an exception to mandatory minimum sentencing laws. It allows a judge to sentence a person below the mandatory minimum term if certain conditions are met.

Fahie denies all the charges and remains on bond and on house arrest at his daughters’ home in Florida for a second year, while sentencing for the duo is currently set for August 21, 2023.

    I am calling for the unconditional release of the Maynards. Further suggesting that she be given her job back as a favor to tola favorite premier the Hon Fahie. But action was are you making such an erroneous suggestion. Glad you asked. This lady and you observe that I called her lady as against the Wrong lady from the funeral home that I refer to as that woman. Lady Maynard knows how to bring down premiers maybe she can help us with this unpopular illegitimate one to get him out of office and into the dog house.

    This whole mess is so stupid. Dumb & Dumber vacation to Miami?
    But in reality it has brought much death and violence to the BVI. 5 years ago you never had people getting machine gunned to death in the middle of the day in Tortola.
    All these knuckleheads should be locked up for a long time. They have killed this community.
    We need to shut the door on all these drugs and choke off the criminals and their guns. We should be asking the UK to bring back the military boats and block these drug runners. We can not continue to be complacent. This is not going to go away!
